The Unknown Heirs, Devisees, Legatees, Executors, Administrators, Spouses and Assigns and the Unknown Guardians of Minor and/or Incompetent Heirs of Michael L. Morris, et al.

In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 7, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, August 21, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

PARCEL I:

Known as being part of Lot 30, Division 4, N.W., Palmyra Township, Portage County, Ohio and being further described as follows:

Beginning at an iron pin at the intersection of the centerline of CH 137 (John Thomas Road) and the centerline of T.H. 129 (Whippoorwill Road), said point also being the West line of Lot 30, Division 4, N.W.; thence East, a distance of 460.00 feet along the centerline of T.H. 129 to a point; thence S. 0 deg. 24' West, a distance of 157.60 feet to an iron pin found, which is the true place of beginning; thence continuing South 0 deg. 24' West, a distance of 50.00 feet to an iron pipe; thence East, a distance of 150.00 feet to an iron pin; thence North 0 deg. 24' East, a distance of 150.00 feet to an iron pin; thence North 0 deg. 24' East, a distance of 50.00 feet to an iron pin found; thence West a distance of 150.00 feet to the true place of beginning and containing 0.17 of an acre of land as surveyed by Terrence R. Hohnhorst, Registered Surveyor No. 5065 in August, 1967.

PARCEL II:

Situated in the Township of Palmyra, County of Portage, State of Ohio and known as being part of Lot 30, Division 4, N.W. of lots in said township, more fully bounded and described as follows:

Beginning as a spike in the centerline of T.H. 129 (Whippoorwill Road), East 460 feet from an iron pipe at the intersection of T.H. 129 of C.H. 137 (John Thomas Road); thence continuing along the centerline of T.H. 129 East, 150.00 feet to a spike; thence continuing along the centerline of T.H. 129 East, 150.00 feet to a spike; thence South 0 deg. 24' West (passing over an iron pipe at 30.00 feet) 157.60 feet to an iron pipe; thence West 150.00 feet to an iron pipe; thence North 0 deg. 24' East (passing over an iron pipe at 127.60 feet) 157.60 feet to the place of beginning and containing 0.542 of an acre of land as surveyed in September 1960 by Leo E. Martin, Registered Surveyor No. 2587.

Be the same more or less, but subject to all legal highways.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 8421 Whippoorwill Rd., Ravenna, OH 44266.

Said Premises Appraised at $140,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
