Being part of Original Lot Number Nine (9) within said township and further described as follows:
Beginning at a point on the centerline of Alpha Road (TH 277) North 33 degrees 04' West, a distance of 185.44 feet from the intersection of Abbott Road (TH 276) said point being the Northwest corner of a parcel conveyed to E. & J. Klimek by deed recorded in Volume 738, Page 131 of the Portage County Records; thence North 87 degrees 35' East, along the Northerly line of said Klimek parcel, a distance of 696.76 feet to a point on the Westerly line of land conveyed to Donna Munn by deed recorded in Volume 373, Page 187 of the Portage County Records; thence North 38 degrees 33' 10" West, along the Westerly line of said Munn parcel, a distance of 25.00 feet to an iron pipe; thence South 87 degrees 41' 30" West, a distance of 694.76 feet to the centerline of Alpha Road, passing through an iron pipe, a distance of 34.60 feet therefrom; thence South 33 degrees 04' East, along the centerline of Alpha Road, a distance of 25.00 feet to the place of beginning, containing 0.336 acres of land. Beginning on an iron pin set at the intersection of the centerline of Abbott Road (River Road) (TH 276) and Alpha Road (Fruit Farm Road) (TH 277); thence South 33 degrees 04' 00" East, 39.16 feet measured along the centerline of said Fruit Farm Road to an iron pin, the corner of a 1.439/1000 acre parcel of land; thence North 87 degrees 03' 00" East, 718.67 feet along the Northerly line of the 1.439/1000 acre parcel of land to an iron pin on the West line of a parcel of land now or formerly owned by Donna Munn; thence North 38 degrees 33' 13" West, 106.41 feet along the West line of said Munn's land to an iron spike; thence South 87 degrees 03' 00" West, 707.08 feet passing through an iron pipe set on the Easterly margin line of the said Alpha Road 34.71 feet from the centerline and containing to an iron spike set on the centerline of said road; thence South 33 degrees 04' 00" East, 60.84 feet along the centerline to the place of beginning, containing 1.415/1000 acres of land. Beginning on an iron pin set at the intersection of the centerline of Abbott Road (River Road) (TH 276) and Alpha Road (Fruit Farm Road) (TH 277); thence North 33 degrees 04' 00" West, 60.34 feet measured along the centerline of Alpha Road to an iron spike the corner of a 1.415/1000 acre parcel of land THE PRINCIPAL BEGINNING POINT OF THIS SURVEY; thence North 87 degrees 03' 00" East, 707.08 feet passing through an iron pipe set on the Easterly margin line of the said Alpha Road 34.71 feet from the centerline and containing to an iron pin set on the West line of a parcel of land as recorded in Volume 373, Page 187 in the name of Donna Munn; thence North 38 degrees 33' 13" West, 125.00 feet along the West line of the Munn's land to an iron spike; thence South 87 degrees 35' 00" West, 696.76 feet passing through an iron spike on the Easterly margin line of the said Alpha Road 34.71 feet from the centerline and containing to an iron spike on the centerline of said road; thence South 33 degrees 04' 00" East, 125.00 feet along the centerline to the place of beginning, containing 1.66/100 acres of land. Said Premises Appraised at $140,000.00 and cannot be sold for less than two-thirds of that amount.
TERMS OF SALE: CASHIER CHECKS ONLY
If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)
Deposit required by Third Party Purchasers are as follows:
If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).
Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).
Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)
The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)
The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.
The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
