In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, March 27, 2017, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, April 10, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

All that parcel of land in Township of Rootstown, Portage County, State of Ohio, as more fully described in Deed Inst.# 200114247, ID# 320410000056001, being known and designated as Parcel 1:

Situated in the Township of Rootstown, County of Portage and State of Ohio and known as being part of Township Lot 41 and further described as follows:

Beginning at the N.W. corner of Sublot 19 of Clearview Acres as recorded in Vol. 16, Page 1, of the Portage County Record of Plats; thence S. 2 deg. 50' 49" E., a distance of 195.50 feet along the West line of said Sublot 19 to an iron pipe; thence Southerly on a curve to the left (delta 60 deg. 00, radius 60.00 feet, chord 60.00 feet bearing S. 1 deg. 17 W), a distance of 62.83 feet to an iron pipe; thence S. 45 deg. 12 W., a distance of 113.11 feet to an iron pipe at the South corner of Sublot 20 of the above described allotment; thence N. 44 deg. 48 W., a distance of 248.97 feet along the Southwest side of said Sublot 20 to an iron pipe; thence N. 57 deg. 22' 48" E., a distance of 51.00 feet along the N.W. side of Sublot 20 to an iron pipe; thence S. 70 deg. 46 E., a distance of 23.28 feet to an iron pipe; thence N. 9 deg. 13 E., a distance of 175.00 feet to an iron pipe; thence S. 88 deg. 43 E., a distance of 50.00 feet to the place of beginning and containing .922 acres of land of which .894 acres is in said Sublot 20 of Clearview Acres Allotment, as surveyed by A. Kenneth Boydell, Registered Surveyor No. 4434

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 3015 Queen Road, Ravenna, OH 44266.

Said Premises Appraised at $142,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
