In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, December 12, 2016, at 11:00 A.M. If any parcel does not sell (NO BID) or receive sufficient bid, it shall be offered for sale, on Monday, January 9, 2017 at 11:00 A.M. to the highest bidder no minimum bid, but subject to ORC 2329.21, relating to costs, allowance and real estate taxes.

The following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

Known as being a part of Original Lot No. 45 in Hiram Township, before the Organization of Garrettsville Township, and more particularly known as being a part of Subdivision No. 11, according to J. Cole's survey, made in A. D. 1870. Bounded and described as follows:

Beginning in a Southeasterly line of Freedom Street at a post standing 111.9 feet South 51 deg. 45 min. West from the Northeasterly corner of said subdivision; thence South 22 deg. 56 min. East, 150 feet; thence South 51 deg. 45 min. West, 59.35 feet; thence North 22 deg. 56 min. West, 150 feet to the Southeasterly line of Freedom Street; thence North 51 deg. 45 min. East, 59.35 feet to the place of beginning, containing, according to the Auditor's duplicate, 20/100 of an acre. Known as being a part of Original Lot No. 45 of Hiram Township, before the orgination of Garrettsville Township, and more particularly known as being a part of Subdivision No. 11, bounded and described as follows:

Beginning at an iron pipe in the South line of Original Lot No. 45, distant 393.45 feet from the center line of White Street and at the Southeast corner of lands recently deeded in Elmer Lawless; thence containing on said original lot line N. 85 deg. 25 min. W., 187.99 feet, out to an iron pipe at the Southeasterly corner of lands recently deeded to Roger C. Knowlton, et al.; thence along Knowlton's West line, N. 19 deg. 51 min. W., 196.06 feet, but at an iron pipe at said Knowlton's Northeast corner; thence N. 55 deg. 50 min. E., along the rear line of lands of Slagle, Polifrons and Long, 178.10 feet, but to an iron pipe at the Southwesterly corner of the Long lands; thence E. 19 deg. 35 min. E., 317.96 feet but to the place of beginning and being a parcel of land at the rear of other lands of the within named Grantee and without frontage on any street. Containing, acording to the survey of R. O. Whitacre (No. 416), 1.02 acres of land and being a part of a tract of 3.30 acres deeded to the grants herein on November 20, 1943, by deed of record in Volume 394, Page 375 of Portage County Records.

The sheriff's office nor any affiliate have access to the inside of said property.

Said Premises Located at 10628 Freedom St. & Vacant Land, Garrettsville, OH.

Said Premises Appraised at $90,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: CASHIER CHECKS ONLY

If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)

Deposit required by Third Party Purchasers are as follows:

If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).

Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).

Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)

The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)

The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.

The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
