The following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Windham to-wit:
Situated in the Township of Windham, County of Portage and State of Ohio and known as being a part of Original Lot No. 90 in said township and bounded and described as follows:
Beginning at a "PK Nail" set in the centerline of Colton Road (Township Highway No. 252A) 60 feet wide from which an iron pin was set South 89 deg. 37' 00" East, 30.00 feet; said beginning point being North 0 deg. 23' 00" East as measured along said centerline of distance of 304.62 feet from the Southwesterly corner of land conveyed to A. A. Rocco Trucking Company by deed recorded in Volume 727, Page 563 of Portage County Deed Records, said corner being North 89 deg. 25' 00" West, a distance of 11.77 feet from a 1/2" iron pin found marking the Southerly line thereof, said corner being North 0 deg. 23' 00" East as measured along said centerline a distance of 101.50 feet from the intersection of said centerline with the Southerly line of said Original Lot No. 90 thereof:
Course 1: Thence North 0 deg. 23' 00" East along said centerline a distance of 250.00 feet to a P.K. Nail set, from said point an iron pin was set South 89 deg. 37' 00" East, 30.00 feet;
Course 2: Thence South 89 deg. 37' 00" East at right angles to said centerline and through said iron pin set at 30.00 feet a total distance of 378.48 feet to an iron pin set;
Course 3: Thence South 0 deg. 23' 00" West and parallel with said centerline, a distance of 250.00 feet to an iron pin set;
Course 4: Thence North 89 deg. 37' 00" West and parallel with Course No. 2 herein and through said iron pin set at 348.48 feet for a total distance of 378.48 feet to the place of beginning and containing 94.620 square feet (2.172 acres) of land. 7,500 square feet (0.1722 acres) of which is with in the right-of-way of said Colton Road and 87,120 square feet (2.00 acres) is net land, according to a survey made by John G. Hay, Registered Ohio Professional Surveyor No. 7149 in September, 1996. The four (4) iron pins set as indicated above are 5/8" rebar 30" long with yellow plastic identification caps as required. The basis for the bearings used herein is that of an adjacent survey in which Colton Road bears South 0 deg. 23' 00" West.

Said Premises Appraised at $175,000.00 and cannot be sold for less than two-thirds of that amount.
TERMS OF SALE: CASHIER CHECKS ONLY
If the Judgment Credit is the purchaser at the sale, they shall not be required to make a sale deposit. (ORC 2329.21)
Deposit required by Third Party Purchasers are as follows:
If appraised less than or equal to ten thousand dollars ($10,000.00) the deposit shall be two thousand dollars ($2,000.00).
Greater than ten thousand dollars ($10,000.00), but less than or equal to two hundred thousand dollars, the deposit shall be five thousand dollars ($5,000.00).
Greater than two hundred thousand dollars ($200,000.00) the deposit shall be ten thousand dollars ($10,000.00)
The purchaser shall submit to the selling officer a Purchaser Information Form. The Plaintiff should have the form prepared in advance of the sale to present to the Sheriff conducting the sale at the time of sale. (ORC 2923.71)
The purchaser shall be responsible for costs, allowance and taxes that the proceeds of the sale are insufficient to cover.
The Purchaser must pay balance due within thirty (30) days of the confirmation of sale. (ORC 2329.30)
