In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 29, 2016, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Windham to-wit:

Situated in the Village of Windham, in County of Portage and State of Ohio:

And known as being part of Lot No. 50, bounded and described as follows:

Beginning at a point in the North line of said Lot 50, 1424.94 feet West, of the Northeast corner of said Lot 50, the true place of beginning for this description; thence South, a distance of 1765.5 feet to a point in the North line of lands of the Erie Railroad Company; thence East along the North line of lands of the said Erie Railroad Company, a distance of 490.53 feet to a point; same being the Southwest corner of lands now or formerly owned by A. Peterson; thence North along said Peterson's West line, a distance of 1791.0 feet to a point in the North line of said Lot 50, being also in the centerline of State Route 303; thence West along the North lot line and centerline of highway, a distance of 489.90 feet to the place of beginning and containing 20 acres of land, more or less.

Excepting therefrom the following described premises:

And known as being part of Lot 50 in said township and further described as follows:

Beginning at a point in the North line of said Lot 50 being also in the centerline of State Route 303, the true place of beginning for this description; said point being also the Northwest corner of lands now or formerly owned by A. Peterson; thence South along said Peterson's West line and parallel to the Portage-Trumbull County line, a distance of 200.00 feet to a point; thence West and parallel to the North lot line, a distance of 100.00 feet to a point; thence North and parallel to said Portage-Trumbull County line, a distance of 200.00 feet to a point; thence East along the said North lot line, a distance of 100.00 feet to a point and containing 0.46 acres of land. Said exception is more particularly described as follows:

Situated in the township, county and state aforesaid and further known as part of Lot 50 more fully described as follows:

Beginning at a point in the centerline of East Center Street or S.R. 303, that is, North 89 deg. 35' West, a distance of 935.04 feet from the East line of said township or county; thence South 0 deg. 25' West, a distance of 200.00 feet to a pin; thence North 89 deg. 35' West, a distance of 100.00 feet to a pin; thence North 0 deg. 25' East, a distance of 200.00 feet to the centerline of East Center Street or S.R. 303; thence South 89 deg. 35' East, by said centerline, a distance of 100 feet to the place of beginning and containing 46/100 (0.46) of an acre as surveyed by Glenn O. Turner, R.S. No. 4109.

Situated in the Township of Windham, County of Portage and State of Ohio:

And known as being part of Lot 50 in said township, and further described as follows:

Beginning at a point in the centerline of State Route 303, said point being North 89 deg. 15' West, 1284.94 feet along said centerline from the Northeast corner of said Lot 50; thence continuing along the centerline of State Route 303, North 89 deg. 15' West, 140.00 feet to a point; thence due South, 250.00 feet to an iron pipe; thence South 89 deg. 15' East, 140.00 feet to an iron pipe; thence due North, 250.00 feet to the place of beginning and containing 0.803 acre of land, as surveyed July 1966, by Robert A. Turso, Registered Surveyor No. 4632.

Said Premises Located at 10600 SR 303, Windham, OH.

Said Premises Appraised at $65,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
