In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 29, 2016, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

Also known as being part of Lots 34 and 35 in said Franklin Township and more fully described as follows:

Beginning at the Southwest corner of the Buena Vista Allotment, as delineated in the County of Portage Records of Plats, Book 3, Page 20; thence with the South line of said allotment N. 87 deg. 10' E., 234.65 feet to a point in the centerline of West Shore Drive (T.H. 526) 30 feet wide; thence with the centerline of said road following a curve to the left having a radius of 424.41 feet, arc of 66.93 feet, and chord of 65.86 feet bearing S. 10 deg. 18' 58" W. to a point on said centerline; thence with various boundary lines of P. Swigart the following:

S. 65 deg. 41' W., 100.00 feet to a point S. 1 deg. 24' 05" W. 65.00 feet to an iron pipe found; S. 85 deg. 14' W. 59.98 feet to an iron pipe found which was set by Don Trocchio; S. 03 deg. 05' 16" W. 50.32 feet to a Trocchio pipe found marking the true place of beginning for the parcel herein to be conveyed; thence N. 85 deg. 41' E., 166.60 feet to the centerline of said West Shore Drive and passing over an iron pin found 15.25 feet from said road centerline; thence with the centerline of said road following a curve to the left having a central angle of 5 deg. 11' 53", radius of 424.41 feet, arc of 38.50 and chord bearing of S. 12 deg. 14' 24" E., a chord of 38.49 feet to a point of tangency in said road centerline; thence continuing with the centerline of said West Shore Drive S. 14 deg. 50' 20" E., 42.94 feet to a point; thence S. 85 deg. 41' W., 190.18 feet to an iron pin set and passing over an iron pin set 15.25 feet from said road centerline; thence N. 03 deg. 05' 15" E., 81.00 feet to the true place of beginning. Containing 0.3278 acres of land for which 0.1803 ac. are in Lot 34 and 0.1425 are are in Lot 35, be the same more or less, but subject to all legal highways and restrictions of record and reserving a ten foot wide strip of land along the front, rear and sides of said parcel for the installation and/or maintenance of storm drainage and any other utility, as surveyed and determined from local records and monumention in October, 1989, by Douglas E. Bedore, Professional Surveyor 6023.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
