In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, June 20, 2016, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Heaton, said point being the true place of beginning for the herein described parcel of land; thence continuing S. 02 deg. 25' 40" W., along the centerline of Freedom Road, C.H. 211, a distance of 100.00 feet to a point; thence N. 88 deg. 44' 42" W., passing over a 5/8" pipe found 28.00 feet, a total distance of 295.00 feet to a 5/8" pipe found; thence N. 2 deg. 25' 40" E., a distance of 30.00 feet to a 5/8" pipe found; thence N. 88 deg. 44' 42" W., a distance of 1385.44 feet to a 5/8" pipe found in the Westerly line of Lot 58; thence N. 00 deg. 57' 40" E., along the Westerly line of Lot 58, a distance of 130.93 feet to a point; thence S. 88 deg. 44' 42" E., along a Southerly line of said Heaton lands, a distance of 1187.38 feet to a 5/8" 30" long iron pin set; thence N. 01 deg. 15' 18" E., a distance of 52.68 feet to a 5/8" 30" long iron pin set with ID cap; thence S. 88 deg. 44' 42" E., a distance of 150.00 feet to a 5/8" 30" long iron pin set with ID cap; thence S. 32 deg. 26' 40" E., a distance of 136.57 feet to a 5/8" 30" long iron pin set with ID cap; thence S. 88 deg. 44' 42" E., passing over a 5/8" 30" long iron pin set at 239.39 feet, a total distance of 269.39 feet to a point in the centerline of Freedom Road, C.H. 211, returning to the true place of beginning and containing an area of 5.056 acres as surveyed by Danny L. Wilson, P.S. Ohio 7238 in June 2001. Be the same more or less, but subject to all legal highways.

Save and except easements and restrictions of record, zoning, ordinances, real estate taxes and assessments, if any, prorated to the date of this deed.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
