In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 14, 2015, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

Being a part of Lot Number Thirty-eight (38) in said township and bounded and described as follows:

Beginning at a 1" iron pipe found at the intersection of the Northeasterly corner of Lot Number Thirty-eight (38) and centerline of T.H. 102 Biltz Road; thence South 00 degrees 08' 30" West along the Easterly line of Lot Number Thirty-eight (38) and centerline of T.H. 102, a distance of 245.76 feet to a point which marks the true place of beginning for the following described parcel of land; thence continuing South 00 degrees 08' 30" West along the Easterly line of Lot Number Thirty-eight (38) and centerline of T.H. 102, a distance of 109.80 feet to a point of at an angle of said centerline; thence South 20 degrees 59' 54" West continuing along the centerline of T.H. 102, a distance of 7.70 feet to a point at the Northeasterly corner of land now or formerly owned by D. A. Ponick, Sr., (OR 231, Pg. 651); thence North eighty-eight (88) degrees 37' 22" West along the Northerly line of said Ponick, Sr. (passing over a 5/8" iron rod set at 31.85 feet), a distance of 642.26 feet to a 5/8" iron rod set; thence North 00 degrees 08' 30" East, a distance of 117.05 feet to a 5/8" iron rod set; thence South 88 degrees 37' 22" East (passing over a 5/8" iron rod set at 614.99 feet), a distance of 645.00 feet to the true place of beginning, containing 1.7326 acres of land, more or less, of which 0.0806 acres, more or less, are in the right of way of T.H. 102 as surveyed and described December 13, 2002 by Rob A. Szuch, Registered Professional Surveyor No. 7288. Be the same more or less, but subject to all legal highways.

Said Premises Appraised at $85,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
