In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Stephen J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 10, 2015, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

Known as being a part of Original Lot No. 1 in Nelson Township and more particularly known as being the whole of Village Lot No. 58 according to the survey of J. Cole, made A.D. 1870, of record in Vol. 2, Page 7, Portage County Records of Plats. Excepting therefrom:

A strip of sixteen inches wide off the East side of said lot, as conveyed by G. F. Hoskin and Harriet Hoskin to Charles A. Curtiss on October 24, 1879. Also excepting therefrom:

Bounded on the front and rear by the original lines of Lot 58 and on the Easterly side by the Easterly line of the premises above mentioned, and on the Westerly side by a line parallel to and at all points 60 feet distant Westerly from said Easterly line, the said premises hereby conveyed having a frontage of 60 feet on the Northerly side of Water Street, be the same more or less, but subject to all legal highways.

Also excepting therefrom:

Beginning at a point on the North line of Water Street, which is the Southerly line of said Lot 58 distant 61 feet and 4 inches from the Southeast corner of said lot, which said point is on the dividing line between the property now owned by the Grantors and the Grantees; thence Westerly along the lot line and the North line of Water Street 5 feet to a point; thence Northerly and parallel to the lot line to the rear of the lot; thence Easterly on the rear lot line 5 feet to the Northwest corner of property now owned by the Grantees herein as shown by deed of record in Vol. 568, Page 41; thence Southerly along the Grantees line and parallel to the lot line to the point of beginning and being a strip of land 5 feet in width off the Easterly line of the Grantors premises, extending from front to the rear and of uniform width throughout, be the same more or less, but subject to all legal highways.

Said Premises Located at 8281 Water St., Garrettsville, OH 44231-0000.

Said Premises Appraised at $125,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
