In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate Steven J. Smith's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, January 26, 2015, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Situated in the Township of Freedom, County of Portage and State of Ohio and known as being part of Lot 57 in Freedom Township and further described as follows:

Beginning at an iron spike in the centerline of Freedom Road and being S. 2 deg. 19' W., 642.70 feet from the intersection of said road centerline with the North line of Lot 57; thence S. 89 deg. 19' E., 911.37 feet to an iron pipe in the East line of Lot 57 and passing over an iron pipe 30.01 feet from the road center; thence S. 0 deg. 30' W., 299.88 feet along the East line of Lot 57; thence N. 89 deg. 19' W., 920.87 feet to the centerline of Freedom Road; thence N. 2 deg. 19' E., 300.00 feet along the centerline of Freedom Road to the beginning. Containing 6.307 acres of land, be the same more or less, but subject to all legal highways, as surveyed in May, 1994 by Edward J. Collier, Registered Surveyor No. 7141. Excepting therefrom:

And being known as part of Lot 57 of said township and further bounded and described as follows:

Beginning at a 2" pin found at the intersection of the North line of Lot 57 and the centerline of Freedom Road (CH 211); thence South 2 deg. 19' 00" West, along said road centerline, a distance of 642.70 feet to a point and the Northwest corner of land conveyed to J. Vankirk by Volume 652, Page 677 of Portage County Records of Deeds, which point is the true place of beginning for the parcel herein described; thence South 89 deg. 19' 00" East, along the North line of said Vankirk's land and passing over a 1/2" pipe found at 30.01 feet, a distance of 911.37 feet to a 1/2" pipe found on the East line of said lot; thence South 0 deg. 30' 00" West, along said lot line, a distance of 149.94 feet to 1/2" pipe found; thence North 89 deg. 19' 00" West, along a new line and passing over a 1/2" pipe found at 886.11 feet, a distance of 916.12 feet to a point on said road centerline; thence North 2 deg. 19' 00" East, along said road centerline, a distance of 150.00 feet to the true point of beginning and containing 3.1452 acres of land as surveyed in August, 2002 by Clifford H. McGuire, Professional Surveyor No. 7770. Deed of Record: 1160-524 to A. or C. Feller. Basis of Bearing: Survey Plat P-10673.

Said Premises Appraised at $44,500.00 SET MINIMUM BID and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
