In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 22, 2014, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

FIRST TRACT:

Situated in the Township of Rootstown, County of Portage and State of Ohio and known as part of Lot No. 17 in said township, bounded as follows:

Beginning at a stone at the Northwest corner of land in said lot, formerly owned by Elias Dronberger formerly and running thence South 89 deg. 55' East 25 chains 70 links to a post; thence South 0 deg. 15' West 15 chains 51 links to a post; thence West 25 chains 70 links to a stone; thence North 0 deg. 15' East 15 chains 59 links to the place of beginning, containing 40 acres of land less 7/1000 of an acre sold off the Northeast corner to the C. & P. Railroad Company. For exception to first tract-see attached Page 2 at bottom.

SECOND TRACT:

Situated in the Township of Rootstown, County of Portage and State of Ohio and known as part of Lot No. 20 of said Rootstown Township, bounded as follows:

Beginning at a point in the center of the highway at the Southwest corner of A. H. Hallocks land; thence North 0 deg. 30' East 17 chains 24 links to a post; thence North 88 deg. 15' West 30 links to a post; thence South 0 deg. 30' West 17 chains 24 links to a point in the highway above named and thence South 88 deg. 15' East to the place of beginning. Containing 52/100 acres of land. Reserving from the above premises the right of way heretofore given to the C. A. & M. V. Street Car Company.

THIRD TRACT:

Situated in the Township of Rootstown, County of Portage and State of Ohio, and known as being part of Lot No. 17, Township 2, Range 8, Connecticut-Western Reserve, bounded and described as follows:

Beginning at a point in the Northerly line of land now or formerly of John O'Hare and distant 85 feet measured Southwestwardly and at right angles from a point in the line established as the original center line of railroad of the Cleveland and Pittsburg Railroad Company, known as the Cleveland Division; said beginning point being in a line bearing South 89 deg. 11' West from another point in said center line of railroad at Survey Station 4856 plus 10.3 therein; extending from said beginning point South 89 deg. 11' West by said lands now or formerly of John O'Hare, the distance of 634 feet and 43/100 of a foot to a corner; thence North 0 deg. 15' East, by land now or formerly of Lana Scott, the distance of 939 and 36/100 of a foot more or less, to a point and thence South 34 deg. 7' East by land of the Cleveland and Pittsburg Railroad Company on a line parallel with the distance 85 feet measured Southwestwardly and at right angles from said original center line of railroad, the distance of 1123 feet and 71/100 of a foot, more or less, to the place of beginning, containing 6.84 acres, more or less. Subject to easement for ingress and egress and subject to special covenants for fencing arrangements.

FOURTH TRACT:

Situated in the Township of Rootstown, County of Portage and State of Ohio and known as being located on the Westerly side of the Cleveland and Pittsburg right-of-way; extending from lands of the Pennsylvania Railroad Company on the South to lands known as the John P. Jones property on the North and bounded by the right-of-way of the Cleveland and Pittsburg Railroad on the East and being located in Lot No. 17 of the aforesaid named township and county, said parcel being 92 feet long. Said strip or parcel being 55 ft. in width and sufficient land in addition to enable said second party, its successors or assigns to construct and maintain all necessary slopes, cuts and embankments. Contains about 0.11 of an acre, more or less and being the same tract of land as described as Parcel No. 125 in a certain deed from Milton C. Portmann, Special Master Commissioner, Action No. 186018 Common Pleas Court of Cuyahoga County to the Northern Realty Company and recorded in Volume 290, Page 1, in deed records of Portage County.

FIFTH TRACT:

Situated in the Township of Rootstown, County of Portage and State of Ohio, and known as being a parcel or strip of land on the Westerly side of the Cleveland and Pittsburgh right-of-way in Lot No. 17 of the aforesaid named township and county, extending from lands of Andrew Kraiss on the South to lands of J. S. Ely on the North, being 33 deg. 29' West of North and adjoining the present Cleveland & Pittsburg right-of-way. Said strip of parcel being 45 feet in width and sufficient land in addition to enable said second party its successors or assigns to construct and maintain all necessary slopes, cuts and embankments, containing about 2.79 acres, more or less and being the same tract of land as Parcel No. 126 of a certain deed from Milton C. Portmann, Special Master Commissioner Action 186018 Common Pleas Court of Cuyahoga County to Northern Realty Company and recorded in Volume 290, Page 1 in deed records of Portage County.

EXCEPTION:

Situated in the Township of Rootstown, County of Portage and State of Ohio:

And known as being a part of Rootstownship Lot No. 17 and 20, and is further bounded and described as follows:

Beginning at a stone found in the East line of Lot No. 20 at the Northwest corner of land conveyed to Margaret McCosh as recorded in Volume 644, Page 507 of Portage County Deed Records; thence South 00-24-00 East along the East line of Lot No. 20, a distance of 991.58 feet to a corner of land conveyed to the Bishop Brothers as recorded in Volume 468, Page 279 of Portage County Deed Records; thence S. 84 deg. 13' Westerly along a Southerly line of land conveyed to the Bishop Brothers as aforesaid a distance of 24.72 feet to an Easterly line of land conveyed to the Bishop Brothers as aforesaid; thence S. 00 deg. 24' E. along the Easterly line of land conveyed to the Bishop Brothers as aforesaid a distance of 1140.88 feet to a point in the centerline of T.H. 99-D; thence S. 88 deg. 51' E. along the centerline of T.H. 99-D, a distance of 24.72 feet to the Southwest corner of land conveyed to Marie Mlasofsky as recorded in Volume 411, Page 197 of Portage County Deed Records, said point also being the Southwest corner of Lot No. 20; thence N. 00 deg. 24' W., along the Westerly line of land conveyed to Marie Mlasofsky aforesaid and the Easterly line of Lot No. 20, a distance of 1103.52 feet to the Northwest corner of land conveyed to Marie Mlasofsky as aforesaid; thence S. 89 deg. 24' E., along the Northerly line of land conveyed to Marie Mlasofsky as aforesaid, a distance of 1030.96 feet to a point; thence N. 00 deg. 24' W. and parallel to the Easterly line of Lot No. 20, a distance of 1028.94 feet to a point in the Southerly line of land conveyed to Ohio Farmettes, Inc., as recorded in Volume 725, Page 893 of Portage County Deed Records; thence South 89-24-00 West along the Southerly line of land conveyed to Ohio Farmettes, Inc., a distance of 1030.96 feet to the place of beginning and containing 25.00 acres of land, be the same more or less, but subject to all legal highways. Surveyed by Clarence H. Miller, Registered Surveyor No. 4844. There being .52 acres in Lot No. 20 and the balance in Lot No. 17. There is included with the conveyance of the above described parcel the grant of a permanent easement over a 45-foot strip of land known as the former street car line extending South from Sandy Lake Road, along the East side of other lands of Grantee corporation to Grantors remaining land. Grantee corporation shall have a permanent easement over said 45-foot strip for highway purposes, but must share in the maintenance of said 45-foot strip and same shall be kept open at all times for ingress and egress by Grantor.

Excepting real estate taxes and assessments, both general and special, which shall be pro-rated on the date of transfer and shall thereafter be assumed and paid by the Grantees, easements and leases of record, building restrictions and zoning regulations.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
