In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 11, 2014, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

PARCEL NO. 1:

Situated in the Township of Brimfield, County of Portage and State of Ohio:

Known as being Sublot No. 154A in Beechcrest Allotment No. 4, as the same is platted, numbered and recorded in Plat Book 16, Page 74, Portage County Records of Plats.

PARCEL NO. 2:

Land to be conveyed to J. E. & S. J. Holmes 1661 Cherrywood Road (Brimfield Township) Kent, Ohio 44240, by reason of the vacation of part of Neville Drive, Township Highway 1130 by passage of a Resolution 67-106 on July 3, 1967 by the County Commissioners of Portage County. Situated in the Township of Brimfield, County of Portage and State of Ohio, being a Westerly half of a portion of what was formerly known as Neville Drive and described as follows:

Beginning at the Northeasterly corner of Lot 154A of the Beechcrest Allotment No. 4, the plat of which is recorded in Plat Book 16, Page 74 of Portage County Records, said Lot 154A having being conveyed to J. E. & S. J. Holmes on Feb. 2, 1961 by deed recorded in Volume 721, Page 334 of Portage County Records; 1. Thence along the Northerly line of said Beechcrest Allotment No. 4, 25.01 feet to a point in the centerline of Neville Drive, now vacated; 2. Thence due South along said centerline of Neville Drive 166.32 feet to a point in the Northerly line of Cherrywood Road extended Easterly; 3. Thence due West along the Northerly line of Cherrywood Road extended, 45 feet to a point of curvature; thence Northerly along the arc of a curve to the left, (said curve having a radius of 20 feet, central angle of 90 deg., tangent length of Neville Drive); 5. Thence due North along the original Westerly line of Neville Drive, 145.67 feet to the place of beginning, containing 4,236 square feet of land.

Note:

The minutes of the meeting of the commissions at which they approved the vacating of part of Neville Drive are on Pages 225 and 226 the Commissioners' Journal. The plat for the vacation was to be made part of the "Proper Road Records" of said (SIC) Portage County, Ohio. Surveyed by Vance Riley, R.S. 3935, July 20, 1979.

PARCEL NO. 3:

Situated in the State of Ohio, County of Portage, Township of Brimfield, being part of Lot 49 in said township and being the Easterly half of that portion of Neville Drive, T.H. 1130, that was in Beechcrest Allotment No. 4 (Vol. 16, Page 74) that was vacated July 13, 1967 by the Portage County Commissioners by Resolution 67-106 and recorded on Pages 225 & 226 of the Commissioner's Journal and bounded and described as follows:

Beginning at a point at the intersection of the Northerly line of said Lot 49 and the Southwesterly corner of Sub-lot 517 R in Beechcrest Allotment No. 5 as recorded in Vol. 18, Page 67 of the Portage County Record of Plats; thence N. 88 deg. 31' 01" E., along the Northerly line of Lot 49 and the Southerly line of Sub-lot 517 R, a distance of 25.01 feet to a point at the Northwesterly corner of land now or formerly owned by Stanley Peterson (Vol. 1082, Page 528); thence South along the Westerly line of said Peterson, a distance of 166.97 feet to a point in the Northerly line of T.H. 1116, Cherrywood Road; thence West along the Northerly line of said T.H. 1116, a distance of 25.00 feet to a point at the Southeasterly corner of land now owned by Sarah Jane Holmes (Vol. 1095, Pg. 164); thence North along the Easterly line of said Holmes, a distance of 166.32 feet to a place of beginning, containing 0.0956 acres of land, more or less, as surveyed July 12, 1991 by Rob A. Szuch, Registered Professional Surveyor No. 7288 dba Al Szuch & Associates.

Said Premises Appraised at $100,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
