In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 11, 2014, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

The land described herein is situated in the State of Ohio, County of Portage, City of Rootstown and is described as follows:

Situated in the Township of Rootstown, County of Portage and State of Ohio:

And known as being the West one-half of the following described premises:

Being part of Lot 10, beginning at a monument found at the Northwest corner of said Lot No. 10 which is also the approximate centerline intersection of the C.H. 18, Tallmadge Road and Highway No. 31 (Ravenna-Marlbor Road now known as New Mulford Road); thence South 87 deg. 42' East along the North line of said Lot No. 10 and centerline of C.H. 18 for a distance of 661.25 feet to a point which marks the true place of beginning of the following described parcel of land; this true place of beginning is at the Northeast corner of a 2.50 acre parcel of land owned by H. L. and V. Frame; thence South 01 deg. 30' W., along the East side of said Frame property for a distance of 679.60 feet to an iron pipe at the Southeast corner of said Frame property; thence South 88 deg. 45' East for a distance of 161.50 feet to an iron pipe; thence North 01 deg. 30' East for a distance of 676.03 feet to a point in the North line of said Lot No. 10; thence North 87 deg. 42' West along the North line of said Lot No. 10 for a distance of 161.52 feet to the true place of beginning and found to contain 2.51 acres of land as surveyed by Lucius F. Converse, R.S. No. 1199, in November 1954.

Note:

Iron pipes were set South 01 deg. 30' West, a distance of 33.00 feet from the North line of said Lot No. 10 on both of the North and South lines. Intending to convey in this description 1.255 acres of land, be the same more or less, but subject to all legal highways.

Save and except the following described parcel of land situated in the Township of Rootstown, County of Portage and State of Ohio:

And known as being part of the O.L. 10 in said township. Beginning for commence at the intersection of Tallmadge Road C.H. 18 and New Milford Road C.H. 31; thence S. 87 degs. 42' 00" E., along the centerline of Tallmadge Road C.H. 18, a distance of 742.00 feet to a point and the true place of beginning for the property herein described, said property owned by B. A. Adamson and B. S. Coleman, Deed Volume 1106, Page 820; thence continuing along the centerline of Tallmadge Road C.H. 18, S. 87 degs. 42' 00" E., a distance of 80.76 feet to a point; thence turning S. 01 degs. 30' 00" W., along the West property line of property owned by Marsh Creek Dev. Co. Inc. and passing over an iron pipe at 33.00', a distance of 676.63 feet to a point, witness an iron pipe 0.27' North; thence turning N. 88 degs. 45' 00" W., along the North property line of property owned by S. & H. Development, a distance of 80.76 feet to a point, witness a rebar 0.49' North and 1.98' West; thence turning N. 01 degs. 30' 00" E., along the East property line of property owned by M. S. & M. P. Oer, Deed Volume 965, Page 455, a distance of 678.11 feet to a point in the centerline of Tallmadge Road C.H. 18 and back to the true place of beginning, containing 1.2558 acres of land more or less, and excepting all legal highways and easements of record, as surveyed by Terrence L. Pearson, P.S. #7305 in March of 2001. Leaving a balance of 1.26 acres of land.

Said Premises Appraised at $75,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
