In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, May 19, 2014, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Hiram to-wit:

Situated in the Township of Hiram, County of Portage and State of Ohio:

Known as being a part of Original Hiram Township Lot No. 9 and being a part of the land as recorded in Volume 446, Page 413 of the Portage County Records of Deeds and is bounded and described as follows:

Beginning on an iron pipe set at the intersection of the centerlines of Abbott Road (T.H. 26) and Allen Road (T.H. 281); thence South 33 degrees 04' 00" East, 441.36 feet along the centerline of Abbott Road, passing through an iron spike 304.29 feet therefrom the Southeast corner of a 2.713 acre parcel of land in the name of Maud B. Vaughan and continuing to an iron spike set at the intersection of a 50 foot right of way; thence South 78 degrees 23' 00" West, 370.29 feet along the centerline of the 50 foot right of way to an iron pipe, the point of intersection PI of a curve to the left having a PI angle of 82 degrees 26' 00", a radius o 228.32 feet, a tangent of 200.00 feet; thence South 4 degrees 03' 00" East, 301.63 feet measured along the centerline of the 50 foot right of way to an iron spike the corner of Lots Nos. 24 and 25 of the proposed Hiram Rapids Riverview Allotment the principal beginning point of this survey; thence North 87 degrees 41' 00" East, 276.62 feet passing through an iron spike on the East margin line of 50 foot right of way and continuing along the South line of Lot No. 25 to an iron spike; thence South 33 degrees 04' 00" East, 114.36 feet to an iron pipe the corner of Lots No. 23 and 24; thence South 87 degrees 27' 00" West, 327.03 feet along the North line of Lot No. 23 to an iron spike on the centerline of 50 foot right of way; thence North 4 degrees 03' 00" West, 100.00 feet along the centerline to the place of beginning, be the same more or less, but subject to all legal highways. Survey and description made and prepared by L. S. Spear, Surveyor, Registered No. 1262. Being the same premises as conveyed in deed from Dale L. Kubicki, unmarried, recorded 11/03/1997 in Document Number 9724053 in said county and state.

Said Premises Located at 12610 Cadek Road, Hiram, Ohio 44234.

Said Premises Appraised at $95,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
