In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, February 10, 2014, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Hiram to-wit:

Parcel Nos. 21-026-00-00-004-000 and 21-026-00-00-015-000

PARCEL NO. 1:

Situated in the Township of Hiram, County of Portage and State of Ohio and known as being part of Lot No. 26 in Hiram Township and further described as follows:

Beginning at a point in the centerline of S.R. 88 and the East line of Lot No. 26 and being South 0 degrees 04 minutes 14 seconds West, 914.13 feet from a monument at the Northeast corner of Lot No. 26; thence South 0 degrees 04 minutes 14 seconds West, 359.66 feet along the centerline of SR 88 and the East line of Lot 26; thence North 89 degrees 24 minutes West, 1195.12 feet to an iron pin in the Grantor's West line and passing over an iron pipe 30 feet from the road center; thence North 0 degrees 47 minutes 11 seconds East, 365.54 feet to an iron pipe at the Grantors Northwest corner; thence South 89 degrees 07 minutes East, 1190.61 feet to the beginning and passing over an iron pipe 30 feet from the road center, containing 9.929 acres of land, be the same more or less, as surveyed by David Collier, Registered Surveyor No. 4819, April 1975.

Situated in the Township of Hiram, County of Portage and State of Ohio and known as being part of Lot 26 in said township and bounded and described as follows:

Beginning at a 3/4" iron pipe found at the Southeasterly corner of Sublot 17 in the Western Reserve Subdivision, as recorded in Volume 19, Page 42 of the Portage County Record of Plats; thence South 88 degrees 54 minutes 46 seconds East, a distance of 449.94 feet to a 1/2" iron pipe found at the Southwesterly corner of land now or formerly owned by A. E. and V. R. Lentz (Vol. 865, Page 333); thence South 88 degrees 57 minutes 37 seconds East along the Southerly line of said Lentz, a distance of 506.81 feet to a 2" iron pipe found at the Southwesterly corner of land now of formerly owned by J. J. and K. A. Miller (Volume 1035, Page 971); thence South 89 degrees 34 minutes 54 seconds East along the Southerly line of said J. J. and K. A. Miller, a distance of 134.91 feet to a 2" iron pipe found at the Southwesterly corner of land now or formerly owned by F. and R. J. Miller (Volume 891, Page 916); thence South 89 degrees 15 minutes 56 seconds East along the Southerly line of said F. & R. J. Miller, a distance of 88.79 feet to a 2" iron pipe found at the Northwesterly corner of land now or formerly owned by C. F. Jr. or W. R. Crissman (Volume 1082, Page 421); thence South 00 degrees 27 minutes 10 seconds West along the Westerly line of said Crissman Westerly line of land now or formerly owned by O. M. or J. M. Riffle (Volume 942, Page 420 and Westerly line of land now or formerly owned by K. & C. Ross and G. Smith (Volume 1055, Page 420) and Westerly line of land now or formerly owned by K. & C. Ross and G. Smith (Volume 1055, Page 65), a distance of 610.55 feet to a 1/2" iron pipe found in a Northerly line of said lands now or formerly owned by M. E. Herndon (Volume 964, Page 224 and Volume 988, Page 312); thence North 89 degrees 44 minutes 52 seconds West along Herndon's said Northerly line, a distance of 1180.44 feet to a 1/2" iron pipe found at the Southeasterly corner of land now or formerly owned by R. J. or J. M. Ruff (Volume 1057, Page 354); thence North 00 degrees 27 minutes 20 seconds East along the Easterly line of said Ruff and Easterly line of land now or formerly owned by V. E. III or S. M. Sisson (Volume 1085, Page 894), a distance of 625.21 feet to the place of beginning, containing 16.720 acres of land more or less as surveyed March 5, 1990, by Al Szuch & Associates, Registered Professional Surveyor No. 5398.

Said Premises Located at 11615 State Route 88, Garrettsville, Ohio 44231.

Said Premises Appraised at $175,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
