In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, January 13, 2014, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

The land referred to herein below is situated in the County of Portage, State of OH, and is described as follows:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Known as being part of Lot No. 82 in said township, beginning at a point in the Southwest corner of Lot No. 82, said point also being in the centerline of C.H. 31, Section G known as the Ravenna-Marlboro Road; thence N. 5 deg. 00' E., and along the centerline of said Ravenna-Marlboro Road, a distance of 395.55 feet to a point, the true place of beginning.

Thence continuing N. 5 deg. 00' E., along the centerline of said Ravenna-Marlboro Road, a distance of 242.05 feet to a point; thence S. 85 deg. 33' E., along the South line of H. C. and K. D. Roundy land and the North line of property now or formerly owned by J. A. and G. M. Riemenschneider, and passing over a steel dowel in a corner stone (which was formerly used in line fences), a distance of 27.14 feet from the centerline of the aforementioned road, a distance of 535.00 feet from said centerline to an iron pipe; thence N. 85 deg. 33' W., and passing over an iron pipe 27.14 feet from the centerline of said Ravenna-Marlboro Road, a distance of 535.00 feet to said centerline of the aforementioned road and the true place of beginning and containing 2.973 acres; thence S. 5 deg. 00' W., a distance of 242.05 feet to an iron pipe. Excepting therefrom:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Beginning at a point on the West line of Lot No. 82 in the centerline of County Highway No. 31 (Ravenna-Marlboro Road) said beginning point being N. 5 deg. 00' E. and 542.00 feet from the Southwest corner of said lot; thence N. 5 deg. 00' E., along the centerline of C.H. No. 31 and the West line of Lot No. 82, 95.60 feet to a nail which marks the Southwest corner of the R. C. and K. D. Roundy property; thence S. 85 deg. 33' E., along Roundy's South property line (passing over an iron pipe at 27.14 feet) 535.00 feet to an iron pipe; thence S. 5 deg. 00' W., parallel with the roads centerline and lot line and G. and E. Riemenschneider property line 95.60 feet to an iron pipe; thence N. 85 deg. 33' W., parallel with Roundy's South property line (passing over an iron pipe at 807.86 feet) 535.00 feet to the centerline of C.H. No. 31 the place of beginning, containing 1.174 acres of land, be the same more or less, but subject to all legal highways. Surveyed by P. Gray and L. Harvey in November, 1957.

Said Premises Located at 2200 New Milford Rd., Atwater, Ohio 44201.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
