In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 23, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

Situated in the State of Ohio, County of Portage and Township of Palmyra and being part of Division 3, Lot 19 of said Palmyra Township and being part of a parcel now or formerly owned by John Carl, Inc. (Image #200500410) and being more particularly described as follows:

Beginning at a 5/8" steel rod with Deibel cap set at the Southwest corner of said Division 3, Lot 19; thence S. 00 deg. 51' 53" E., along the West line of Division 3, Lot 21 of said Palmyra Township, a distance of 365.54 feet to a 1" pipe found; thence N. 89 deg. 44' 09" E., along lands now or formerly owned by Florence J. Hallock (Volume 676, Page 419), a distance of 2633.64 feet (and passing over a 1" pipe found at a distance of 2600.87 feet) to a point; thence N. 01 deg. 21' 09" W., along the East line of said Division 3, Lot 21 and Lot 19 and the centerline of State Route 225 (66' wide), a distance of 488.83 feet to a point and the true place of beginning of the herein described parcel:

1. Thence S. 88 deg. 38' 51" W., a distance of 368.28 feet (and passing over a 5/8" steel rod with Deibel cap set at a distance of 33.00 feet) to a 5/8" steel rod with Deibel cap set;

2. Thence N. 10 deg. 52' 15" W., a distance of 210.00 feet to a 5/8" steel rod with Deibel cap set;

3. Thence N. 25 deg. 51' 00" E., a distance of 135.44 feet to a 5/8" steel rod with Deibel cap set at a point of curvature;

4. Thence along a curve to the left having a radius of 345.00 feet, a delta of 30 deg. 12' 09", a tangent of 93.10 feet, a chord of 179.76 feet and a chord bearing of S. 79 deg. 15' 05" E., an arc distance of 181.86 feet to a 5/8" steel rod with Deibel cap set at a point of tangency;

5. Thence N. 85 deg. 38' 51" E., a distance of 100.89 feet to a 5/8" steel rod with Deibel cap set at a point of curvature;

6. Thence along a curve to the right having a radius of 30.00 feet, a delta of 93 deg. 00' 00", a tangent of 31.61 feet, a chord of 43.52 feet and a chord bearing of S. 47 deg. 51' 09" E., an arc distance of 48.69 feet to a 5/8" steel rod with Deibel cap set;

7. Thence N. 88 deg. 38' 51" E., a distance of 33.00 feet to a point;

8. Thence S. 01 deg. 21' 09" E., along the East line of said Division 3, Lot 19 and the centerline of said State Route 225, a distance of 265.21 feet to a point and the true place of beginning of the herein described parcel.

The above described parcel contains 2.597 acres, of which 0.201 acre lie within the public road right-of-way, as surveyed under the supervision of Curtis G. Deibel, P.S. #6673, in March, 2005. Subject to the right-of-way of State Route 225 (66' wide). The bearings are based on Ohio State Plane Coordinates, North Zone.

Said Premises Located at 3253 State Route 225, Diamond, Ohio 44412.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
