In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 23, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Suffield to-wit:

Situated in the Township of Suffield, County of Portage and State of Ohio and being part of Lot #24:

Beginning at 1/2" iron bar found at the Southwest corner of said Lot 24; thence No. 01 deg. 00' 00" E., along the centerline of S.R. 43 a 60 foot public right-of-way and the West line of said Lot 24, a distance of 283.89 feet to a P.K. nail set and the true place of beginning;

1.) Thence continuing N. 01 deg. 00' 00" E., along the centerline of said S.R. 43 and the West line of said Lot 24, a distance of 225.00 feet to a PK nail set;

2.) Thence S. 89 deg. 00' 00" E., a distance of 665.00 feet to a 1/2" iron bar with a cap set (passing over a 1/2" iron bar with cap set on the East right-of-way of S.R. 43, 30.00 feet from the centerline);

3.) Thence S. 01 deg. 00' 00" E., a distance of 225.00 feet to a 1/2" iron bar with cap set;

4.) Thence N. 89 deg. 00' 00" W., a distance of 665.00 feet to a PK nail set and the true place of beginning (passing over a 1/2" iron bar with cap set on the East right-of-way of said S.R. 43, 30.00 feet from the centerline.

The above described tract of land encloses and comprises part of a tract that was conveyed to Michael F. & Christine M. Palumbo by a deed recorded in Volume 953, Page 883, Portage County Deed Records and contains 3.435 acres as surveyed by Ronald P. Dohy, P.S. #6175 of Hammontree and Associates, Limited, Engineers and Surveyors of North Canton, Ohio in June of 1989. Subject to an easement of 30 feet off the entire West end for roadway purposes. The basis of bearing is assumed.

Said Premises Appraised at $200,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
