In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 16, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Atwater to-wit:

Situated in the State of Ohio, County of Portage and the Township of Atwater, and being part of Lot 89 in said township. Beginning for commencement at the intersection of the South right of way of Waterloo Rd. C.H. 87-M 60' R/W and the West line of Lot 89, witness an iron pipe found; thence S. 89 deg. 00' 00" E., along the South right of way of Waterloo Road C.H. 87-M, a distance of 313.50 feet to a rebar found, and the true place of beginning for the property herein described; thence continuing S. 89 deg. 00' 00" E., along the South right of way of Waterloo Rd. C.H. 87-M, a distance of 66.00 feet to a P.K. nail set in concrete; thence running S. 00 deg. 26' 51" W., along the East right of way of Grate Ave. T.H. 444, 33' R/W, a distance of 181.50 feet a capped rebar set; thence turning N. 89 deg. 00' 00" W., along the North line of D. L. or D. L. Dillon, O.R.V. 87, Page 387, a distance of 66.00 feet to a capped rebar set; thence turning N. 00 deg. 26' 51" E., along the East line of R. A. Lynn, D. V. 680, Page 469, a distance of 181.50 feet back to the true place of beginning. The area contained in this property is 0.2750 acres of land more or less. The basis of bearing is to an assumed meridian, and denotes angles only. The survey was performed by Terrence L. Pearson P.S. #7305 in May of 2005. The property being conveyed is held in fee title by M. M. Whittlesey Family Limited Partnership O.R.V. 292, Page 674.

Said Premises Located at 6410 Waterloo Road, Atwater, Ohio 44201.

Said Premises Appraised at $110,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
