In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 16, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Franklin to-wit:

And known as being part of Lot 79 in Franklin Township and further described as follows:

Beginning at an iron pipe in the South line of Lot 79 at the Southeast corner of Newton Road and being S. 89 deg. 34' E., 767.02 feet from an iron pipe at the intersection of said lot line with the centerline of Hudson Road; thence N. 0 deg. 26' E., 50.00 feet to an iron pipe at the Northeast corner of Newton Road; thence N. 89 deg. 34' W., 185.00 feet along the North line of Newton Road to an iron pipe; thence N. 14 deg. 00' 11" W., 222.25 feet to an iron pipe; thence S. 76 deg. 42' 40" E., 740.19 feet to a point in Stewart Lake at the Grantor's Northeast corner; thence S. 24 deg. 21' W., 110.00 feet to a point in the South line of Lot 79; thence N. 89 deg. 34' W., 436.64 feet along the South line of Lot 79 to the beginning. Containing 2.566 arcres of land, be the same more or less, but subject to all legal highways, as surveyed by David J. Collier, Registered Surveyor No. 4819.

Beginning at a drill hole in concrete in the North line of Lot 66 at the Southeast corner of Newton Road and being S. 89 deg. 34' E., 767.02 feet from an iron pipe at the intersection of said lot line with the centerline of Newton Road; thence S. 89 deg. 34' E., 210.00 feet along the North line of Lot 66 to a point; thence S. 0 deg. 26' W., 14.00 feet to a point; thence N. 89 deg. 34' W., 210.00 feet to an iron pipe; thence N. 0 deg. 26' E., 14.00 feet to the beginning. Containing 0.067 of an arc of land, be the same more or less and reserving a 3 ft. wide walkway easement along the South side of said land; said easement is further described as follows:

Starting at the Southeast corner of Newton Road in the North line of Lot 66; thence S. 0 deg. 26' W., 11.00 feet to the Northwest corner of said easement and the true place of beginning; thence S. 89 deg. 34' E., 210.00 feet; thence S. 0 deg. 26' W., 3.00 feet; thence N. 89 deg. 34' W., 210.00 feet to an iron pipe; thence N. 0 deg. 26' E., 3.00 feet to the beginning. A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale.
