In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 12, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

Situated in the City of Kent, County of Portage and State of Ohio:

Known as being Lot Number Eleven (11) in Ross-Prouse Acres Allotment as the same is platted and recorded in Plat Book 7, Pages 8 and 9 of Portage County Records. Excepting therefrom the following 3 parcels:

Exception No. 1:

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being the Northerly 100.00 feet off of Lot No. 11 of the Ross & Prouse Acres Allotment, Plat Book 7, Page 8 & 9 in Franklin Township Lot 10, and containing 0.55 acres of land, witness iron pipes found or set at all corners as surveyed by Herbert V. Wands, Reg. Surv. 3347, July 16, 1957.

Exception No. 2:

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being a part of Original Lot 10 Franklin Township and a part of Sublot 11 of the Ross and Prouse Acres Allotment Plat Book 7, Pages 8 and 9 and further described as follows:

Beginning at an iron pin found at the Southeast corner of said Sublot 11; thence North 00 deg. 16' 00" East, 156.90 ft. to an iron pin set and the true place of beginning of the following described parcel of land; thence North 89 deg. 19' 00" West, 240.00 ft. to an iron pin set on the Easterly right of way line of Deidrick Rd.; thence North 00 deg. 16' 00" East, 95.00 ft. along the Easterly line of Deidrick Rd. to an iron pin found; thence South 89 deg. 19' 00" East, 240.00 ft. to an iron pin found; thence South 00 deg. 16' 00" West, 95.00 ft. to an iron pin and the true place of beginning, and containing 0.523 acres of land as surveyed by James N. Connor, Reg. Surveyor No. 4570 June, 1976.

Exception No. 3:

Situated in the City of Kent, County of Portage and State of Ohio and known as being a part of Lot 10 in said city and also a part of Sublot 11 of Ross & Prouse Acres Allot. as record in Plat Book 7, Pages 8 and 9, and further bounded and described as follows:

Beginning at an iron pin set at the Southwest corner of said Sublot 11 which is also the intersection of the Northerly line of Chelton Drive 50' wide and the Easterly line of Deidrick Road 50' wide; thence North 00 deg. 16' 00" East, 156.90 ft. along the Easterly line of Deidrick Rd., to an iron pin found; thence 89 deg. 19' 00" East, 100.00 ft. to an iron pin set; thence South 00 deg. 16' 00" West, 156.90 ft. to an iron pin set at the Northerly line of Chelton Dr.; thence North 89 deg. 19' 00" West, 100.00 ft. to the point of beginning and containing 0.360 acres of land more or less, as surveyed by James N. Connor, Reg. Surveyor 4570, March, 1978.

Said Premises Located at 1327 Chelton Dr., Kent, Ohio 44240.

Said Premises Appraised at $114,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
