In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, July 22, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Streetsboro to-wit:

And known as being part of Streetsboro Township Lot 85 and further described as follows:

Beginning at a nail in the centerline of Kennedy Road and being S. 88 deg. 54' E., 851.21 feet from an iron pipe at the intersection of said road centerline with the centerline of Ferguson Road; thence North a distance of 397.95 feet to an iron pipe in the Grantor's North line and passing over an iron pipe 30.00 feet from the road center; thence S. 89 deg. 02' 50" E., 499.97 feet along the Grantor's North line and the South line of J. A. Williams to an iron pipe; thence South a distance of 399.23 feet to the centerline of Kennedy Road and passing over an iron pipe 30.00 feet from the road center; thence N. 88 deg. 54' W., 500.00 feet along said centerline to the beginning. Containing 4.574 acres of land, be the same more or less, but subject to all legal highways as surveyed in July, 1988 by Edward J. Collier, Registered Surveyor No. 7141. Excepting therefrom the following parcel of land:

D. and J. M. Schall O.R.V. 42, Page 122, a distance of 397.76 feet to an iron pipe found and passing over a capped pin found 30.00 feet from the centerline; thence turning S. 89 deg. 05' 04" E., along the South line of L. L. and J. P. Mikes D.V. 1111, Page 260 a distance of 275.02 feet to a capped rebar set and the true place of beginning for the property herein described; thence continuing S. 89 deg. 05' 04" E., along the South line of L. L. and J. P. Mikes D.V. 1111, Page 260, a distance of 225.08 feet to an iron pipe found; thence turning S. 00 deg. 00' 16" E., along the West line of D. J. Plaso D.V. 1050, Page 1056, a distance of 399.37 feet to a point in the centerline of Kennedy Rd. and passing over an iron pin found 30.00 feet from the centerline; thence turning N. 88 deg. 54' 00" W., along the centerline of Kennedy Rd. a distance of 201.15 feet to a point; thence turning N. 00 deg. 09' 40" E., through the land of the Grantor a distance of 200.00 feet to a capped rebar set and passing over a capped rebar set 30.00 feet from the centerline; thence turning N. 79 deg. 28' 03" W., through the land of the Grantor a distance of 24.90 feet to a capped rebar set; thence turning N. 00 deg. 00' 49" W., through the land of the Grantor, a distance of 194.56 feet back to the true place of beginning and containing 1.9490 acres of land more or less. This survey was performed in May of 2004 by Terrence L. Pearson, P.S. #7305. The basis of bearing is to an assumed meridian and is denoted by angles only. The property is conveyed is held in fee title by R. G. and P. Wolford D.V. 1121, Page 300.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
