In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, June 24, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Kent to-wit:

PARCEL ONE:

Situated in the City of Kent, County of Portage and State of Ohio:

And known as being the Easterly 40 feet of Lot 171 and the Westerly 12 feet of Lot 172 of Woodard Heights Allotment, as recorded in Plat Book 4, Page 44, of Portage County Records, and further described as follows:

Beginning at an iron pin in the North line of Lot 172, which is 12 feet Easterly from the Northwest corner of said lot; thence S. 14 deg. 21' W., 92.40 feet to an iron pin in the North line of Cuyahoga Street; thence along a curve to the left having a radius of 240 feet and a chord of 52 feet, 52.10 feet to an iron pin; thence N. 14 deg. 16' 20" E., 95.08 feet to an iron pin in the North line of Lot 171; thence S. 77 deg. 05' E., 52 feet to the place of beginning, be the same more or less, but subject to all legal highways.

PARCEL TWO:

And known as being a part of Lots 169 and 170, Woodard Heights Allotment, as recorded in Plat Book 4, Page 44, and more fully described as follows:

Beginning at the Northwest corner of Lot 169, said point being the true place of beginning; thence S. 76 deg. 46' E., along the North line of Lot 169, 59.00 feet to an iron pipe; thence S. 14 deg. 21' E., a distance of 100.90 feet to an iron pipe in the South line of Lot 170; thence N. 75 deg. 05' 48" W., a distance of 51.27 feet to an iron pipe; thence N. 14 deg. 18' E., a distance of 50.92 feet to an iron pipe; thence N. 89 deg. 32' W., a distance of 6.90 feet to an iron pipe; thence N. 13 deg. 14' E., a distance of 50.00 feet to the place of beginning and containing 0.1261 acres of land as surveyed by Richard F. Paul, Registered Surveyor No. 4351 in March, 1973. Be the same more or less, but subject to all legal highways.

Both parcels equal 0.242 acres.

Said Premises Located at 713 Cuyahoga Street, Kent, OH 44240.

Said Premises Appraised at $95,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
