In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, May 20, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

And known as being a part of Lot Number 16 in Rootstown Township, and bounded and described as follows:

Beginning at the Southwest corner of land of E. H. Laubert on the South lot line in the centerline of the highway, 471.20 feet North 88 deg. 30' West from a marked stone at the Southeast corner of Lot Number 16; thence continuing North 88 degrees 30 minutes West along the lot line and center of the highway, 141.19 feet to a point; thence North 1 deg. 12' East, 925.60 feet to an iron pipe on the South line of land of H. S. Moulton and passing over an iron pipe at 33 feet at side of highway; thence South 88 deg. 30' East, 141.19 feet along Moulton's South line to an iron pipe at the Northwest corner of land of E. H. Laubert; thence South 1 deg. 12' West, 925.60 feet along Laubert's West line to the place of beginning and passing over an iron pipe at 33 feet at the side of the highway and containing 3.00 acres of land, as surveyed July 13, 1946 by C. B. Dodge, Registered Surveyor Number 1682.

Excepting and reserving the following described premises:

Situated in the Township of Rootstown, County of Portage and State of Ohio and known as being a part of Lot Number Sixteen (16) in said township, and bounded and described as follows:

Beginning at a point on the South line of said Lot Number 16, which is North 88 deg. 30' West, 542.39 feet from a marked stone at the Southeast corner of said lot; thence continuing North 88 deg. 30' West along the lot line and centerline of the highway 70.00 feet to a point; thence North 1 deg. 12' East, 925.60 feet to an iron pipe on the South line of land of H. S. Moulton and passing over an iron pipe at 33 feet at side of highway; thence South 88 deg. 30' East, 70.00 feet along Moulton's South line to an iron pipe; thence South 1 deg. 12' West, 925.60 feet to the place of beginning and passing over an iron pipe at 33 feet at side of highway, and containing 1.4874 acres of land, as surveyed November 11, 1948, by C. L. Bushey, Registered Surveyor No. 603.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
