In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, May 13, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Situated in the Township of Freedom, County of Portage and State of Ohio and being known as part of Lot 51 of said township and further bounded and described as follows:

Beginning at a point on the East line of said Lot 51 and the centerline of Freedom Burton Road (S.R. 700), at the Northeast corner of land conveyed to G. and P. Waliga by Volume 1159, Page 656 of Portage County Record of Deeds, said point being South 0 deg. 26' 06" East, 2400.48 feet from a 1/2" pipe found at the Northeast corner of said Lot 51 and the centerline intersection of said S.R. 700 and Hankee Road (T.H. 224); thence North 88 deg. 37' 25" West, along the North line of said Waliga's land and along the North line of land conveyed to D. Pochedly by Volume 1132, Page 109 of Portage County Record of Deeds and passing over a 1" pipe found at 30.00 feet, a distance of 1200.00 feet to a capped "McGuire" iron pin found on the East line of land conveyed to Countrytyme Lodi, Ltd. by Portage County Instrument #200532705; thence North 0 deg. 26' 06" West, along said Countrytyme's East line, a distance of 184.00 feet to a 1/2" capped rebar set; thence South 88 deg. 37' 25" East, along a new line and passing over a 5/8" capped rebar set at 1169.98 feet, a distance of 1200.00 feet to a point on the centerline of said S.R. 700; thence South 0 deg. 26' 06" East, along said road centerline, a distance of 184.00 feet to the point of beginning and containing 5.0663 acres of land as surveyed in December, 2005 by Clifford H. McGuire, Professional Surveyor No. 7770. Basis of bearings was taken from Survey Plat P-15718.

Said Premises Located at 10101 State Route 700, Mantua, Ohio 44255.

Said Premises Appraised at $145,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
