The Unknown Heirs, Devisees, Legatees, Executors, Administrators, Spouses and Assigns and the Unknown Guardians of Minor and/or Incompetent Heirs of Doris C. Micle, et al.

In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, February 4, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

Parcel #1 - 7.705 acres

Known as and being a part of Doris C. Micle's 38.355 acre tract recorded in D.V. 995, Page 1002 and being located in Lot #26, Brimfield Township, Portage County, Ohio. Bounded and described as follows:

Beginning for reference at an eye bolt found in a clay tile marking the Northwest corner of said Lot 26; thence S. 88 deg. 59' 51" E., 413.12 feet along the North lot line to a 30" long #5 rebar bearing a cap imprinted JLN 7349 set (as are all #5 rebars set) at the Northwest corner of said 38.355 acre tract, and the Northeast corner of Steve and/or Donna C. Scherer, Trustees 9.297 acre tract recorded in O.R. 200613607; thence S. 00 deg. 38' 48" W., 910.48 feet along the West line of said 38.355 acre tract and the East line of said 9.297 acre tract to a #5 rebar set and being the true place of beginning for the tract herein described; thence

1. S. 89 deg. 21' 12" E., 495.00 feet along a new division line to a #5 rebar set; thence

2. S. 15 deg. 42' 04" W., 258.50 feet along a new division line to a #5 rebar set; thence

3. S. 00 deg. 36' 48" W., 600.00 feet along a new division line to a point on the centerline of Lynn Road (T.H. 99-A), a 60' wide right-of-way and passing over a #5 rebar set 32.27 feet from said centerline; thence

4. N. 67 deg. 43' 37" W., 460.26 feet along said centerline to a point at the Southwest corner of said 38.355 acre tract and the Southeast corner of said 9.297 acre tract, witnessed by a 3/4" iron pipe found S. 00 deg. 38' 48" W., 0.85 feet of said point; thence

5. N. 00 deg. 38' 48" E., 680.00 feet along the West line of said 38.355 acre tract and the East line of said 9.297 acre tract, and passing over a #5 rebar set 32.27 feet from said centerline, to the true place of beginning.

The above described parcel contains 7.705 acres as surveyed by Nichols Field Services, Inc. under the supervision of Jerry L. Nichols, Registered Professional Surveyor #7349 in April of 2007 and is subject to all legal highways and easements of record. The basis of bearing for this document is the East property line of said 36.355 acre tract bearing S. 00 deg. 15' 40" W., as recorded in Cranberry Farm, LLC, Deed Recorded in O.R. 200611689.

Said Premises Located at 2033 Lynn Road, Kent, OH 44240.

Said Premises Appraised at $240,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
