In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, January 7, 2013, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Village of Garrettsville to-wit:

Situated in the Village of Garrettsville, County of Portage and State of Ohio:

Located in Lot 36, Hiram Township, and Subdivision 4 in the Village of Garretsville, Portage County, Ohio, and bounded and described as follows:

Beginning at the point of intersection of the centerline of St. Rt. 82 and Wheeler Road (TH-284); thence North 2 deg. 08' East, along the centerline of Wheeler Road, 852.45 feet to an iron pipe (set by Elgin in 1949) marking a point of angle to the left; thence North 7 deg. 08' 38" West along centerline 45.15 feet to a point, the true place of beginning for the following described premises; thence continuing North 7 deg. 08' 36" West along said centerline 125.65 feet to a point, the intersection of the centerline of Wheeler Road and the South line of "Shawnee Trail No. 1", Volume 29, Page 3; thence South 88 deg. 17' 34" East, passing over an iron pin at 30.23 feet (found marking the Southwest corner of Lot 6 in said subdivision), a total distance of 276.18 feet to an iron pin marking the Southwest corner of Lot 8 in said subdivision; thence South 1 deg. 13' 30" West, 124.16 feet to an iron pipe; thence North 88 deg. 17' 34" West, along the North line of K. M. or K. M. Enoch, passing over an iron pipe at 227.53 feet, a total distance of 257.89 feet to the true place of beginning and containing 0.7612 acres of land as surveyed in August, 1999 by Donald D. Harvey, Regsitered Surveyor No. 4112. Basis of bearings South line - Lots 6-7-8; Shawnee Trail Volume 29, Page 3.

Said Premises Located at 11052 Wheeler Road, Garretsville, OH 44231.

Said Premises Appraised at $135,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
