In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, November 5, 2012, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Paris to-wit:

Situated in the Township of Paris, County of Portage and State of Ohio:

And known as being part of Lot No. 25 in Paris Township, bounded on the North by the North line of Lot No. 25, which is also the centerline of C.H. #177; on the East by the centerline of S.R. #627, now S.R. 225, S.H. 841; on the South by the North right of way line of the former C. A. and M. V. Railroad; and on the West by lands now or formerly owned by Kenneth R. and Elizabeth C. Westover; containing 50.69 acres, more or less.

Excepting therefrom the following seven parcels:

1. Being part of Lot No. 25 in said township, bounded and described as follows:

Beginning at a point in the center of said township and at the intersection of the North and South Center Road with the East and West Center Road, C.H. 177 and S. R. 225; thence S. along the center of the road S.R. 225, 10 rods to a corner; thence W. on the line parallel with the East and West Center Road, 10 rods to a corner; thence North a line parallel with the North and South Center Road 10 rods to the center of the East and West Center Road, C.H. 177; thence E. along the center of East and West Center Road C.H. 177 10 rods to the place of beginning and containing 5/8 of an acre of land, more or less and being the same premises deeded by Bessie Ittu to Adam Simon and Elizabeth Simon, which deed is recorded in Vol. 293, Page 304 and to which reference is made, for a more particular description of said premises.

2. Known as being part of Lot #25 in Paris Township more fully bounded and described as follows:

Beginning in the centerline of St. Rt. #627, S.R. 225 South 0 deg. 27' 30" E., 2280.00 feet and South 5 deg. 39' W., 132.05 feet from the intersection of said S.R. #627, S.R. 225 and the North line of Lot #25 which is also the centerline of County Highway #177; thence continuing along the centerline of St. Rt. #627, S.R. 225, S. 5 deg. 39' W., 223.00 feet to an angle in said S.R. #627, S.R. 225; thence continuing along S.R. #627, S.R. 225 centerline S. 2 deg. 19' W., 172.76 feet to the Northerly line of the old P. & W. R.R. right of way; thence along the Northerly right of way line of said R.R. N. 79 deg. 25' W. (passing over an iron pin at 33.00 feet) 338.40 feet to an iron pipe at the base of a 24 inch wild cherry tree; thence N. 5 deg. 00' W., 364.00 feet to an iron pipe; thence S. 85 deg. 31' E., (passing over an iron pipe at 362.00 feet, 395 feet to the place of beginning and containing 3.116 acres of land as surveyed in July, 1962, by Leo E. Martin, Registered Surveyor #2587. Be the same more or less, but subject to all legal highways.

3. Situated in the Township of Paris, County of Portage and State of Ohio:

Known as being part of Lot 25 in said township and bounded and described as follows:

Beginning at a point in the Northerly line of said Lot 25 at the intersection of the centertline of C.H. 177, Newton Falls Road and the centerline of S.R. 225, Deerfield-Windham Road; thence S. 00 deg. 27' 30" E., along the centerline of S.R. 225, a distance of 2079.61 feet to a point which is the true place of beginning for the following described parcel of land; thence continuing S. 00 deg. 27' 30" E., along the centerline of said S.R. 225, a distance of 201.16 feet to an angle in the centerline of S.R. 225; thence S. 05 deg. 40' 58" W., continuing along the centerline of S.R. 225, a distance of 8.90 feet to a point; thence S. 89 deg. 32' 30" W., a distance of 206.96 feet to an iron pipe; thence N. 00 deg. 27' 30" W., a distance of 210.01 feet to an iron pipe; thence N. 89 deg. 32' 30" E., (passing over an iron pipe at 174.55 feet) a distance of 207.92 feet to the true place of beginning, containing 1.002 acres of land, more or less, as surveyed January 15, 1973 by Albert Szuch, R.S. No. 5398.

4. Situated in the Township of Paris, County of Portage and State of Ohio:

And known as being a part of Lot 25 of said township and further described as follows:

Beginning at a point marking the centerline intersection of C.H. 177, Newton Falls Road and State Route 225; thence North 86 deg. 05' 49" West, a distance of 165.00 feet along the centerline of Newton Falls Road to a point which is the true place of beginning; thence South 4 deg. 08' 47" West, a distance of 165.00 feet along the Westerly line of Paris Inn Inc. to an I.P. and passing over an I.P. at 30.00 feet; thence South 86 deg. 06' 49" East, a distance of 165.00 feet along the Southerly line of Paris Inn Inc. to a point in the centerline of State Route 225 passing over an I.P. 33.00 feet back from said centerline; thence South 4 deg. 08' 47" West, a distance of 266.00 feet along the centerline of State Route 225 to a point; thence North 86 deg. 06' 49" West, a distance of 770.74 feet through the property of the Grantor and along the Northerly line of a 5.016 acre tract to an I.P. and passing over an I.P. at 33.00 feet; thence North 3 deg. 34' 37" East, a distance of 431.00 feet along the Easterly line of K. A. Westover to a point in the centerline of Newton Falls Road and passing over an I.P. 30.00 feet back from said centerline; thence South 86 deg. 06' 49" East, a distance of 610.03 feet along the centerline of Newton Falls Road to the true place of beginning and containing 7.017 acres of land, more or less, as surveyed by Edward P. Wanchick, Registered Survyeor No. 5756. Be the same more or less, but subject to all legal highways.

5. Situated in the Township of Paris, County of Portage and State of Ohio:

And known as being a part of Lot 25 of said township and further described as follows:

Beginning at a point marking the centerline intersection of C.H. 177, Newton Falls Road, and State Route 225; thence South 4 deg. 08' 47" West, a distance of 431.00 feet along the centerline of State Route 225 to a point which is the true place of beginning; thence continuing South 4 deg. 08' 47" West, a distance of 284.00 feet along the said centerline to a point; thence North 86 deg. 06' 49" West, a distance of 767.92 feet through the property of the Grantor to an I.P. and passing over an I.P. at 33.00 feet; thence North 3 deg. 34' 37" East, a distance of 284.00 feet along the Easterly line of K. A. Westover to an I.P.; thence South 88 deg. 06' 49" East, along the Southerly line of a 7.017 acre tract passing over an I.P. at 740.47 feet, a total distance of 770.74 feet to the true place of beginning. Containing 5.016 acres of land, more or less, as surveyed by Edward P. Wanchick, Registered Surveyor No. 5756. Be the same more or less, but subject to all legal highways.

Beginning at a point marking the centerline intersection of C.H. 177, Newton Falls Road and State Route 225; thence South 4 deg. 08' 47" West, a distance of 715.00 feet along the centerline of State Route 225 to a point which is the true place of beginning; thence continuing South 4 deg. 08' 47" West, a distance of 285.00 feet along the said centerline to a point; thence North 86 deg. 06' 49" West, a distance of 765.09 feet through the property of the Grantor to an I.P. and passing over an I.P. at 30.00 feet; thence North 3 deg. 34' 37" East, a distance of 285.00 feet along the Easterly line of K. A. Westover to an I.P.; thence South 86 deg. 06' 49" East, along the Southerly line of a 5.016 acre tract passing over an I.P. at 697.42 feet, a total distance of 767.92 feet to the true place of beginning and containing 5.015 acres of land, more or less, as surveyed by Edward P. Wanchick, Registered Surveyor No. 5756. Be the same more or less, but subject to all legal highways.

7. Situated in the township, county and state aforesaid and known as being part of Lot 25 in said township and bounded and described as follows:

Beginning at a point in the Northerly line of said Lot 25 at the intersection of the centerline of C.H. 177, Newton Falls Road and the centerline of S.R. 225, Deerfield-Windham Road; thence S. 00 deg. 27' 30" E., along the centerline of S.R. 225, a distance of 2280.77 feet to an angle in the centerline of S.R. 225; thence S. 05 deg. 40' 58" W., continuing along the centerline of said S.R. 225, a distance of 8.90 feet to a point which is the true place of beginning for the following described parcel of land; thence S. 05 deg. 40' 58" W., continuing along the centerline of S.R. 225, a distance of 222.68 feet to a point at the Northeasterly corner of land now or formerly owned by O. L. Griffith; thence N. 85 deg. 30' 56" W., along the Northerly line of said O. L. Griffith (passing over an iron pipe at 33.01 feet), a distance of 183.82 feet to an iron pipe; thence N. 00 deg. 27' 30" W., a distance of 205.57 feet to an iron pipe; thence N. 89 deg. 32' 30" E., a distance of 206.96 feet to the true place of beginning, containing 0.958 acres of land, more or less, as surveyed January 15, 1973 by Albert Szuch, R.S. No. 5398.

Said Premises Located at 6293 St. Rt. 225, Ravenna, OH 44266.

Said Premises Appraised at $225,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
