In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, October 15, 2012, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Situated in the Township of Randolph, County of Portage and State of Ohio:

And known as being a part of Lot 97 of said township, bounded and described as follows:

Beginning at the intersection of the centerline of County Highway 69 and Township Highway 44 (Bassett Road); thence Northeasterly along the centerline of County Highway 69 to its intersection with the North line of Randolph Meadows Subdivision No. 1, which point of intersection is the place of beginning; thence continuing Northeasterly along the centerline of County Highway 69 to its intersection with the South line of the property formerly owned by Oscar J. Knapp; thence Easterly along the South line of Knapp's former property for about 4.36 chains to a point in the East line of Lot 97; thence Southerly along the East line of Lot 97 to its intersection with the North line of Randolph Meadows Subdivision No. 1; thence Westerly along the said North line of Randolpoh Meadows, 655.33 feet to the place of beginning, containing 5.5 acres, be the same more or less, but subject to all legal highways.

Excepting therefrom the following parcel:

Situated in the Township of Randolph, County of Portage and State of Ohio:

Known as being a part of Lot 97 in said township, and further described as follows:

Beginning at a railroad spike at the intersection of the centerline of T.H. 44, Bassett Road, and C.H. 69 Hartville Road; thence N. 38 degrees 22' 10" E., along the centerline of C.H. 69, a distance of 638.72 feet to an iron pipe, said point being the true place of beginning for the following described parcel of land; thence continuing N. 38 degrees 22' 10" E., along the centerline of C.H. 69, a distance of 60.67 feet to a point; thence S. 79 degrees 23' 50" E. (passing over an iron pipe at 28.55 feet) a distance of 327.25 feet to an iron pipe at the Northeasterly corner of Lot 1 in the Randolph Meadows No. 1 Subdivision as recorded in Vol. 16, Pg. 51 of the Portage County Records of Plats; thence N. 87 degrees 59' 50" W., along the Northerly line of said subdivision (passing over an iron pipe at 322.30 feet), a distance of 359.56 feet to the true place of beginning, and found to contain 0.202 acres of land, more or less, as surveyed June 13, 1969, by Albert Szuch, Registered Surveyor No. 5398.

Area intended to be conveyed is 5.3 acres.

Said Premises Located at 2664 Hartville Rd., Rootstown, OH 44272-9658.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
