In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, October 15, 2012, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Nelson to-wit:

Being part of Lot 7 in said township and bounded and described as follows:

Beginning at a 5/8" iron rod found at the Northeasterly corner of Lot 7 at the intersection of the centerline of T.H. 282, Adams Road and T.H. 289, Brosius Road; thence N. 89 deg. 01' 07" W., along the Northerly line of Lot 7 and centerline of T.H. 282, a distance of 370.09 feet to a point, which marks the true place of beginning for the following described parcel of land; thence S. 00 deg. 57' 31" W. (passing over a 5/8" iron rod set at 30.00 feet), a distance of 478.06 feet to a 5/8" iron rod set in the Northerly line of land now or formerly owned by R. & A. L. Tate (Vol. 1069, Pg. 422); thence N. 88 deg. 20' 14" W., along Tate's said Northerly line, a distance of 370.03 feet to a 1/2" iron pipe found in the Easterly line of land now or formerly owned by W. R. Huston (O.R. 361/102); thence N. 00 deg. 57' 31" E., along Huston's said Easterly line (passing over a 2" iron rod found at 443.66 feet), a distance of 473.66 feet to a point in the Northerly line of Lot 7 and centerline of T.H. 282; thence S. 89 deg. 01' 07" E., along the Northerly line of Lot 7 and centerline of T.H. 282, a distance of 370.00 feet to the true place of beginning, containing 4.0420 acres of land, more or less, of (which 0.255 acres, more or less, are in the R/W of T.H. 282) as surveyed and described December 7, 1998 by Rob A. Szuch, Registered Professional Surveyor No. 7288. Be the same more or less, but subject to all legal highways.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
