In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 10, 2012, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

Situated in the State of Ohio, County of Portage, Township of Rootstown, (T-2, R-8) and being part of Lot 39 of said Rootstown Township and being part of a parcel now formerly owned by ET Development, Inc. (Instrument #200521424) and being more particulary described as follows:

Beginning at a point at the Northeast corner of said Lot 39 (witnessed by 5/8" steel rod with red cap found S. 00 deg. 37' 41" E., a distance of 29.43 feet); thence N. 89 deg. 09' 53" W., along the North line of said Lot 39 and the centerline of Tallmadge Road (60' wide), a distance of 2497.83 feet to a point and the true place of beginning of the herein described parcel; thence S. 00 deg. 29' 47" E., a distance of 450.13 feet (and passing over a 5/8" steel rod with Deibel cap set; thence S. 89 deg. 30' 13" W., a distance of 274.00 feet to a 5/8" steel rod wit Deibel cap set; thence N. 00 deg. 29' 47" W., along lands now or formerly owned by Robert W. MacGregor, Trustee (Volume 1063, Page 814), a distance of 456.50 feet (and passing over a 1/2" steel pipe found at a distance of 426.49 feet) to a point; thence S. 89 deg. 09' 53" E., along the North line of said Lot 39 and the centerline of said Tallmadge Road, a distance of 274.07 feet to a point and the true place of beginning of the herein described parcel. The above described parcel contains 2.851 acres, of which 0.188 acre lie within the public road right-of-way, as surveyed under the supervision of Curtis G. Deibel, P.S. #6673, in October, 2005. Subject to the right-of-way of Tallmadge Road. Bearings are based in Ohio State Plane Coordinates, North Zone.

Said Premises Located at 3026 Tallmadge Road, Rootstown, Ohio 44240.

Said Premises Appraised at $130,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
