In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, February 27, 2012, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

PARCEL 1:

And known as being a part of Township Lot 83 and being further described as follows:

Beginning at an iron pipe found at the intersection of the Easterly line of said Lot 83 and the centerline of Webb Road (C.H. 204, 60 foot right-of-way); thence South 76 deg. 15' 41" West along the centerline of said Webb Road a distance of 504.83 feet to a point which is the true place of beginning; thence continuing South 76 deg. 15' 41" West, a distance of 10.00 feet along the centerline of said Webb Road to an iron pipe set at the South-Easterly corner of land now or formerly owned by L. B. Cooley; thence North 13 deg. 22' 59" West along the Easterly line of said L. B. Cooley's land, a distance of 250.00 feet to an iron pipe found at the Northeasterly corner thereof and passing over an iron pipe set 30.00 feet from the centerline of said Webb Road; thence North 76 deg. 37' 01" East, a distance of 10.00 feet to an iron pipe set; thence South 13 deg. 22' 59" East, a distance of 249.94 feet to the true place of beginning (and passing over an iron pipe set 30.00 feet from the centerline of said Webb Road) and containing 0.057 acres of land being the same more or less, but subject to all legal highways and easements of record as surveyed by George L. Wood, Registered Surveyor No. 6091, May 1976.

And known as being part of Lot No. 83, township, county and state aforesaid and more particularly described as follows:

Beginning at a point marked by an iron pipe in the centerline of Highway No. 204 (also known as Webb Road). This place of beginning is situated South 71 deg. 19' West, a distance of 517.85 feet from the East line of said Lot No. 83 measured along the centerline of Highway No. 204. This place of beginning is also situated a distance of 3,374.57 feet Southwestwardly from a monument at the centerline of Infirmary Road (Highway No. 154) and Webb Road (Highway No. 204) measured along the centerline of Webb Road; thence South 71 deg. 29' West (and passing over an iron pipe 103.75 feet which iron pipe is at the Northeast corner of a parcel of land now owned by Clarence and Betty Fisher) for a distance of 160.00 feet to an iron pipe; thence at right angles to the preceding course North 18 deg. 31' West for a distance of 250.00 feet to an iron pipe; thence North 71 deg. 29' East for a distance of 160.00 feet to an iron pipe; thence South 18 deg. 31' East for a distance of 250.00 feet to the place of beginning and found to contain 0.918 acres of land as surveyed by Lucious F. Converse, Serial No. 1199 in June, 1954.

Note: Iron pipes were set 30.00 feet North 18 deg. 31' West from the centerline of Webb Road on both of the North and South lines. The above parcel is hereby transferred subject to the following parcel which is excepted therefrom:

B. Cooley which is the true place of beginning; thence North 13 deg. 22' 59" West, along the Westerly line of said L. B. Cooley's land, a distance of 250.00 feet to an iron pipe found at the Northwest corner thereof; thence North 76 deg. 37' 01" East along the Northerly line of said L. B. Cooley's land, a distance of 40.00 feet to an iron pipe set; thence South 4 deg. 17' 34" East, a distance of 253.18 feet to the true place of beginning (and passing over an iron pipe set 30.38 feet from the centerline of said Webb Road) and containing 0.115 acres of land being the same more or less, but subject to all legal highways and easements of record as surveyed by George L. Wood, Registered Surveyor No. 6091 in May 1976.

Said Premises Appraised at $113,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
