In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. Commencing at the intersection of the centerlines of Rock Springs Road (CH-52) and Tallmadge Road (CH-18); thence South 89 deg. 00" East, along the centerline of Tallmadge Road (CH-18), a distance of 1860.78 feet to a point on said line; thence South 0 deg. 45' 07" West, a distance of 30.00 feet to a point on the Southerly right-of-way line of Tallmadge Road (CH-18), said point being the Northeasterly property corner of land now or formerly owned by A. C. Jr. or G. Austin; thence South 89 deg. 00' East along the Southerly right-of-way line of Tallmadge Road (CH-18), a distance of 193.51 feet to a 5/8" rebar with cap no. 5461 set, said point being the true place of beginning for this survey; thence continuing South 89 deg. 00' East, along the Southerly right-of-way line of Tallmadge Road (CH-18), a distance of 332.84 feet to a point on said line at the Northwesterly property corner of land now or formerly owned by J. M. and C. A. Palatas; thence South 1 deg. 00' 39" West along the Westerly property line of land now or formerly owned by J. M. and C. A. Palatas, a distance of 1482.14 feet to a 5/8" rebar found at the Northeasterly property corner of land now or formerly owned by L. E. or C. A. Baker; thence North 89 deg. 00' West, along the Northerly property line of land now or formerly owned by L. E. or C. A. Baker, a distance of 326.14 feet to a 5/8" rebar with cap no. 5461 set; thence North 0 deg. 45' 07" East, along a line running through the Grantor's property, a distance of 1482.15 feet to the true place of beginning for this survey and containing 11.2110 acres of land as surveyed in August 2001, by Floyd L. Thomas, Registered Surveyor No. 5461 of the State of Ohio.

Said Premises Appraised at $165,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale.
