In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, December 5, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the City of Streetsboro to-wit:

PARCEL 1:

Situated in the Township of Hiram, County of Portage and State of Ohio:

Known as being part of Hiram Township Lot 33, and further described as being Lot No. 16 of Cheryl Allotment No. 2 as recorded in Plat Book 17, Page 37, of Portage County Records of Plats. Restrictions and reservations on Sublot No. 16, Cheryl Allotment No. 2.

PARCEL 2:

Situated in the Township of Hiram, Original Lot 33, County of Portage and State of Ohio and more particularly described as follows:

Beginning at an iron pin found at the most Easterly corner of Sublot #17 of Cheryl Allotment as recorded in Volume 17 at Page 37 of Portage County Record of Plats; thence South 70 degrees 26' 11" West for a distance of 81.08' to an iron pin; thence North 14 degrees 32' West for a distance of 92.89' to an iron pin; thence South 22 degrees 22' East (along the common line between Sublot #17 and Sublot #16 of Cheryl Allotment #2) for a distance of 50.98' to an iron pin; thence South 78 degrees 59' East (along the common line between Sublot #17 and Sublot #16 of Cheryl Allotment #2) for a distance of 81.82' to the true place of beginning and found to contain 0.046 acres of land as surveyed by Lucius F. Converse C. E., Registered Surveyor #1199 in October 17, 1973.

And known as being part of Lot No. 33, township, county and state aforesaid and more particularly described as follows:

This irregular parcel of land is being taken from acreage lying directly North of Sublot No. 16 and Sublot No. 17 of Cheryl Allotment No. 2 as recorded in Volume No. 17 at Page 37 of Portage County Record of Plats and more particularly described as follows:

Beginning at an iron pin at the most Northerly corner of said Sublot No. 16, Cheryl Allotment No. 2; thence South 54 degrees 12' 07" West along the North side of said Sublot No. 16 for a distance of 118.92 feet to an iron pin; thence 01 degrees 58' West along the West side of said Sublot No. 16 for a distance of 100.19 feet to an iron pin at the Northeast corner of said Sublot No. 17; thence South 82 degrees 38' West along the North side of said Sublot No. 17 for a distance of 260.52 feet to an iron pin. (This iron pin is situated 12.08 feet North 82 degrees 38' East from an iron pin at the Northwest corner of said Sublot No. 17; thence North 54 degrees 12' 07" East for a distance of 410.50 feet to an iron pin; thence South 34 degrees 47' 53" East for a distance of 45.00 feet to the place of beginning and found to contain 0.569 acres of land as surveyed by Lucius F. Converse, C.E. Registered Surveyor No. 1199 in April, 1968. Be the same more or less, but subject to all legal highways.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
