In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, October 31, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

And known as being part of Original Randolph Township, Lot 51, bounded and described as follows:

Beginning at a stone found in the Northwest corner of Lot No. 51; thence South 1 deg. 04' 16" West along the West line of Lot No. 51, a distance of 1530.80 feet, passing thru an iron pin found 32.59 feet from the center line of C.H. 87-K (Waterloo Road), to an iron pin set in the center line of C.H. 87-K; thence South 65 deg. 47' 02" East along the center line of C.H. 87-K, a distance of 307.60 feet to an iron pin set in the true place of beginning; thence North 1 deg. 26' 30" East, passing thru an iron pin set 32.54 feet from the center line of C.H. 87-K along a line parallel with the West line of the property of John G. and Bonnie R. Hutchison, a distance of 510.11 feet to an iron pin set; thence South 88 deg. 33' 30" East perpendicular to the West line of the property of John G. and Bonnie Hutchison, a distance of 221.29 feet to an iron pin set; thence South 1 deg. 26' 30" West along the West line of the property of John G. and Bonnie R. Hutchison, a distance of 603.01 feet, passing thru an iron pin set 32.54 feet from the center line of C.H. 87-K to an iron pin set in the center line of C.H. 87-K; thence North 65 deg. 47' 02" West along the center line of C.H. 87-K, a distance of 240.00 feet to the true place of beginning and containing 2.827 acres and be the same more or less, but subject to all legal highways as surveyed by John A. Bambeck, Registered Surveyor No. 5141, in October, 1975.

Said Premises Located at 5225 Waterloo Road, Atwater, OH 44201.

Said Premises Appraised at $120,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
