In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, September 19, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

Beginning at an iron pipe in the centerline of Cooley Road and the West line of Lot 2 and being South 2662.80 feet from an iron pipe at the Northwest corner of Lot 2; thence N. 89 deg. 41' 04" E., 1026.50 feet to an iron pipe in the Grantor's East line; thence S. 0 deg. 36' 15" E., 116.99 feet to an iron pipe in the South line of Lot 2; thence S. 89 deg. 10' 20" W., 40.82 feet along the lot line to an iron pipe; thence S. 0 deg. 53' 09" E., 594.00 feet to an iron post at the Grantor's Southeast corner; thence S. 83 deg. 09' 34" W., 1000.71 feet to the centerline of Cooley Road and the West line of Lot 1; thence N. 0 deg. 23' 10" E., 611.82 feet along the centerline of Cooley Road to an iron pipe at the Northwest corner of Lot 1; thence North 126.18 feet along the centerline of Cooley Road and the West line of Lot 2 to the beginning. Containing a total of 16.619 acres of land which 2.867 acres are in Lot 2 and 13.752 acres are in Lot 1, be the same more or less, but subject to all legal highways, as surveyed in July 1977 by David J. Collier, Registered Surveyor No. 4819.

Beginning at an iron pipe in the centerline of Cooley Road and the West line of Lot 1 and being S. 0 deg. 23' 10" W., 303.49 feet from an iron pipe at the Northwest corner of Lot 1; thence N. 88 deg. 09' 34" E., 995.86 feet to an iron pipe in the Grantor's East line and passing over an iron pipe 30 feet from the road center; thence S. 0 deg. 53' 09" E., 218.21 feet to an iron post at the Grantor's Southeast corner; thence S. 88 deg. 09' 34" W., 1000.71 feet to the centerline of Cooley Road and the West line of Lot 1; thence N. 0 deg. 23' 10" E., 218.33 feet along the lot line and centerline of Cooley Road to the beginning, containing 5.000 acres of land, be the same more or less, but subject to all legal highways, as surveyed in July, 1977 by David J. Collier, Registered Surveyor No. 4819.

Said Premises Appraised at $294,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
