In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 22, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

PARCEL ONE:

Situated in the Township of Freedom, County of Portage and State of Ohio:

And known as being part of Lot No. 56 and more particularly described as follows:

Beginning at a monument found at the centerline intersection of S.H. No. 88 and C.H. No. 211 (Freedom Road); thence South 45 deg. 34' West along the centerline of said S.H. 88, for a distance of 864.22 feet to an iron pin which marks the true place of beginning of the following described parcel of land; thence South 89 deg. 20' East (and passing over an iron pipe set 40 feet from the centerline of S.R. 88) for a distance of 304.90 feet to an iron pipe; thence South 04 deg. 49' 40" West for a distance of 300.61 feet to an iron pipe; thence North 80 deg. 11' West for a distance of 207.00 feet to an iron pipe; thence North 88 deg. 14' West for a distance of 81.35 feet to an iron pipe; thence South 13 deg. 04' West for a distance of 42.14 feet to an iron pipe; thence North 76 deg. 56' West for a distance of 246.68 feet to an iron pin in the centerline of S.H. 88; thence North 45 deg. 34' East along the centerline of S.H. 88 for a distance of 357.87 feet to the true place of beginning and found to contain 2.774 acres of land as surveyed by Lucius F. Converse, Serial No. 1199 in August, 1954.

Note:

An iron pipe was set South 76 deg. 56' East, a distance of 30.00 feet from the centerline of Highway No. 88 along the most Southerly line of the parcel.

EXCEPTING THEREFROM THE FOLLOWING PARCEL OF LAND:

Situated in the township, county and state aforesaid and bounded and described as follows:

Beginning at a point in the centerline of S.R. 88 (Ravenna-Parkman Road), said point is South 45 deg. 34' West, 629.19 feet from the intersection of said S.R. 88 and C.H. 211; thence South 0 deg. 40' West, 166.48 feet to an iron pipe and the true place of beginning for the following conveyance of land; thence South 89 deg. 20' East, 139 feet to an iron pipe at the Northwest corner of R. & L. Carter property; thence South 4 deg. 49' 40" West along Carter's West line 300.61 feet to an iron pipe on the South bank of the creek; thence North 80 deg. 11' West, along said South bank of creek 118.69 feet to an iron pipe; thence North 0 deg. 40' East, 280.95 feet to the true place of beginning, containing 0.856 acres of land, as surveyed by R. L. Harvey, RS 1492 and P. Gray in July, 1957 and leaving to be conveyed in the 1st parcel above described 1.91 acres of land as shown by the auditors' tax duplicate.

Situated in the Township of Freedom, County of Portage and State of Ohio:

And known as being a part of Lot 56 and bounded and described as follows:

Beginning at a monument at the intersection of the centerline of C.H. 211 and S.R. 88; thence South 45 deg. 34' West along the centerline of S.H. 88, 629.19 feet to a point and the true place of beginning for the following conveyance of land; thence South 0 deg. 40' East (passing over an iron pipe at 42.50 feet) 166.48 feet to an iron pipe; thence North 89 deg. 20' West (and passing over an iron pipe at 123.55 feet) 165.90 feet to the centerline of S.H. 88; thence North 45 deg. 34' East along said centerline of S.H. 88, 235.03 feet to the true place of beginning and containing 0.317 acres of land as surveyed by P. Gray and R. L. Harvey, R. S. 1492 in July, 1957.

Said Premises Located at 8850 State Route 88, Ravenna, OH 44266.

Said Premises Appraised at $115,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
