In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 22, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Randolph to-wit:

Known as being part of Original Randolph Township Lot No. 57 and is further described as follows:

Beginning at a point at the Northwest corner of said Original Randolph Township Lot 57 in the centerline of Waterloo Rd. C.H. 87, 60' wide at its intersection with the centerline of Hartville Road, C.H. 69, 60' wide; said beginning point being witnessed by a bridge spike found bearing South 33 degrees 29' 26" East, a distance of 1.80 feet; thence along the centerline of Hartville Road and Westerly line of said Original Randolph Township Lot 57, South 00 degrees 32' 00" West, a distance of 314.10 feet but to a point at the Northwest corner of lands now or formerly owned by John E. & Lois Rothermel (OR 49/610) and the true place of beginning for this parcel of land; thence along the Northerly line of the said John E. & Lois J. Rothermel South 87 degrees 30' 00" East, a distance of 146.06 feet but to an iron pipe found at an angle in said line and passing over an iron pipe found at a distance of 30.07 feet; thence continuing along the Northerly line of the said John E. & Lois J. Rothermel, North 00 degrees 32' 00" East, a distance of 6.25 feet but to an iron pipe found at another angle in said line; thence continuing along the Northerly line of said John E. and Lois J. Rothermel South 86 degrees 15' 00" East, a distance of 101.00 feet but to an iron pipe found at the Northeast corner of the said John E. & Lois J. Rothermel; thence along the rear or Easterly line of the said John E. & Lois J. Rothermel South 00 degrees 54' 16" West, a distance of 203.72 feet but to an iron pipe found at the Southeast corner of the said John E. & Lois J. Rothermel; thence along the Southerly line of the said John E. & Lois J. Rothermel North 89 degrees 01' 15" West, a distance of 245.51 feet to a railroad spike set in the centerline of Hartville Road and Westerly line of Original Randolph Township Lot 57 and passing over an iron rod set at a distance of 30.00 feet from said centerline and lot line; thence along the centerline of Hartville Road and Westerly line of Original Randolph Township Lot 57 North 00 degrees East, a distance of 206.24 feet but to the true place of beginning and containing a total of 1.1588 acres of land of which about 0.1418 acres are currently occupied by the Hartville Road right-of-way, be the same more or less as surveyed and described in August 1999 by Don Trocchio, Registered Surveyor No. 6445; bearings used are to an assumed meridian and are used to described angles only.

Said Premises Located at 1594 Hartville Road, Mogadore, Ohio 44260.

Said Premises Appraised at $90,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
