In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 15, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Palmyra to-wit:

And being part of Lot No. 1, Division 3 West and more fully described as follows:

Beginning at the centerline intersection of Tallmadge Road (CH-18, 60 feet wide) and Alliance Road (CH-125-C, 60 feet wide); thence S. 00 deg. 13' 12" E., along the centerline of said Alliance Road, a distance of 530.69 feet to a point, said point being the true place of beginning of the parcel herein to be described; thence N. 89 deg. 59' 17" E., passing over an iron pipe found at 29.92 feet from centerline, a distance of 753.00 feet to an iron pipe found; thence S. 01 deg. 13' 52" E., a distance of 245.42 feet to a point (witnessed by an iron pin found 0.50 feet West); thence S. 85 deg. 02' 55" W., a distance of 561.13 feet to an iron pin set; thence N. 00 deg. 13' 12" W., a distance of 100.00 to an iron pin set; thence S. 84 deg. 02' 55" W., passing over an iron pipe found 30.15 feet from centerline, a distance of 200.00 feet to a point on the centerline of said Alliance Road; thence N. 00 deg. 13' 12" W., along said centerline, a distance of 224.13 feet to the true place of beginning. Said parcel contains 4.4816 acres of land, more or less, and is subject to all legal highways and easements of record as surveyed in September 2000 by Gregory H. Polles, Registered Surveyor No. 6572.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
