In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, August 8, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Rootstown to-wit:

Being part of Lot 38 in said township and bounded and described as follows:

Beginning at a point in the Southerly line of Lot 38 at the intersection of the centerline of C.H. 82, Old Forge Road and T. H. 102, Biltz Road; thence North 00 deg. 11' 00" East, along the centerline of T.H. 102, a distance of 1834.07 feet to a 1/2 inch iron pipe found; thence North 21 deg. 00' 00" East, continuing along the centerline of T.H. 102, a distance of 199.96 feet to a point which marks the true place of beginning for the following described parcel of land; thence continuing North 21 deg. 00' 00" East, along the centerline of T.H. 102, a distance of 376.00 feet to a point; thence South 63 deg. 05' 00" East (passing over a 5/8 inch iron rod set at 30.16 feet), a distance of 212.00 feet to a 5/8 inch iron rod set; thence South 47 deg. 00' 00" East, a distance of 304.94 feet to a 5/8 inch iron rod set in the Westerly line of land now or formerly owned by V. C. Fox, M. V. Flower or L. Fox (Volume 837, Page 816 and Volume 947, Page 84); thence South 00 deg. 03' 42" West, along Fox's said Westerly line a distance of 55.03 feet to a 1/2 inch iron pipe found at the Northeasterly corner of land now or formerly owned by D. A. and S. L. Brunner (Volume 956, Page 330); thence North 89 deg. 10' 00" North, along the Northerly line of Brunner (passing over a 1/2 inch iron pipe found at 514.89 feet) a distance of 546.80 feet to the true place of beginning, containing 2.6812 acres of land, more or less, as surveyed December 1, 1992 by Rob A. Szuch, Registered Surveyor No. 7288 dba Al Szuch & Associates. Be the same more or less, but subject to all legal highways.

Said Premises Appraised at $145,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
