The Huntington National Bank, Plaintiff vs. Dwight L. Smith aka Dwight Smith aka Dwight L. Smith, Sr., et al., Defendants.

To: Dwight L. Smith aka Dwight Smith aka Dwight L. Smith, Sr., whose last known place of residence is 1130 State Route 183, Atwater, OH 44201-9573 and the Unknown Heirs, Devisees, their Spouses and Creditors, Legatees and the Fiduciary of the Estate and Spouse and Creditors of Dwight L. Smith aka Dwight Smith aka Dwight L. Smith, Sr., Deceased, whose last known places of residence are unknown, each of you will take notice that on February 3, 2011, Plaintiff, filed a Complaint for Foreclosure in the Portage County Court of Common Pleas, being Case No. 2010 CV 00480, alleging that there is due to the Plaintiff the sum of $39,719.68, plus interest at the rate of 4.25000% (variable) per annum from October 9, 2010, plus late charges applicable to the terms of the Note and Mortgage on a Promissory Note secured by a Mortgage Deed of even date conveying the following-described property, to-wit:

Permanent Parcel Number: 01-028-00-00-029-000

The Plaintiff further alleges that by reason of the default of the Defendant obligors in the payment of said note according to its tenor, the conditions of said Mortgage Deed have been broken and the same has become absolute.

Plaintiff prays that the Defendants named above be required to answer and set forth its interest in said real estate, or be forever barred from asserting the same, for foreclosure of said mortgage, marshalling of liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Plaintiff's claim in the proper order of its priority, and for such other relief as is just and equitable.

The Defendants named above are required to answer on or before the 29th day of July, 2011.
