JPMorgan Chase Bank, N.A., Successor by Merger to Bank One N.A., 3415 Vision Drive, Columbus, OH 43219, Plaintiff vs. Andrea Sue Swaney, Executor of the Estate of Sheila R. Lappin, et al., Defendants.

The Unknown Heirs, Devisees, their Spouses and Creditors, Legatees and the Fiduciary of the Estate and Spouses and Creditors of Sheila R. Lappin, deceased, whose last known places of residence are unknown, each of you will take notice that on March 17, 2011, JPMorgan Chase Bank, N.A., Successor by Merger to Bank One N.A. filed its Complaint in Case No. 2011 CV 00330 in the Court of Common Pleas, Portage County, Ohio, alleging that there is due to the Plaintiff the sum of $28,360.64, plus interest at 7.3000% per annum from March 12, 2010, plus late charges and attorney fees applicable to the terms of the Promissory Note secured by a Mortgage on the real property, which has a street address of 6468 Cherry Lane, Kent, OH 44240, being Permanent Parcel Numbers: 12-039-10-00-088-000 & 12-039-10-00-089-000

The Petitioner further alleges that by reason of default of the Defendants in the payment of a promissory note, according to its tenor, the conditions of a concurrent mortgage deed given to secure the payment of said note and conveying the premises described, have been broken, and the same has become absolute.

The Petitioner prays that the Defendants named above be required to answer and set up their interest in said real estate or be forever barred from asserting the same, for foreclosure of said mortgage, the marshalling of any liens, and the sale of said real estate, and the proceeds of said sale applied to the payment of Petitioner's claim in the proper order of its priority, and for such other and further relief as is just and equitable.

The Defendants named above are required to answer on or before July 18, 2011.
