In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, June 6, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

Situated in the Township of Shalersville, County of Portage and State of Ohio, and known as being part of Lot No. 13 in Shalersville Township, and further described as follows:

Beginning at a point in the centerline of Peck Road and the West line of Lot No. 13 and being North 0 deg. 19' 03" East, 995.00 feet from an iron rod at the intersection of said road centerline with the centerline of Streeter Road and the Southwest corner of Lot No. 13; thence N. 0 deg. 19' 03" E., 334.07 feet along the centerline of Peck Road and the West line of Lot No. 13 to an iron pipe at the Grantor's Northwest corner; thence S. 89 deg. 53' E., 652.00 feet along the Grantor's North line to an iron pipe and passing over an iron pipe 30 feet from the road center; thence S. 0 deg. 19' 03" W., 334.07 feet to an iron pipe; thence N. 89 deg. 53' W., 652.00 feet to the beginning and passing over an iron pipe 30 feet from the road center, containing 5.000 acres of land, be the same more or less, as surveyed by David J. collier, Reg. Sur. No. 4819, June, 1979.

Beginning at a point in the centerline of Peck Road and the West line of Lot 13 and being N. 0 deg. 19' 03" E., 830.00 feet from an iron rod at the intersection of said road centerline with the centerline of Streeter Road and the Southwest corner of Lot 13; thence N. 0 deg. 19' 03" E., 165.00 feet along the lot line and centerline of Peck Road to the Grantee's Southwest corner; thence S. 89 deg. 53' E., 652.00 feet to the Grantee's Southeast corner; thence S. 0 deg. 19' 03" W., 167.16 feet; thence N. 89 deg. 41' 30" W., 652.00 feet to the beginning. Containing 2.486 acres of land, be the same more or less, as surveyed by David J. Collier, Reg. Sur. No. 4819, June 1979.

Said Premises Appraised at $100,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
