In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, May 2, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Windham to-wit:

Situated in the Township of Windham, County of Portage and State of Ohio:

Located in Lots 93 and 94, Windham Township and Lot 9, Nelson Township and bounded and described as follows:

Beginning at the point of intersection of the centerline of Twinsburg-Warren Road (SR 82) and the East line of Lot 93, Windham Township; thence North 50 deg. 00' West, along the centerline of Twinsburg-Warren Road, 156.97 feet to a point; thence North 39 deg. 44' 30" East, 1381.42 feet passing over an iron pipe at the point of angle; thence North 4 deg. 49' East, 888.72 feet to the North line of Windham Township and continuing North 4 deg. 49' East, a total distance of 1381.42 feet to an iron pipe in the South line of lands of J. J. and S. Drumm in Lot 9, Nelson Township; thence South 89 deg. 48' 18" East, along the South line of said Drumm lands, 122.91 feet to an iron pipe; thence South 4 deg. 47' West, 492.91 feet to the North line of Windham Township and continuing South 4 deg. 47' West, 136.55 feet a total distance of 1529.46 feet to an iron pipe at a point of angle; thence South 39 deg. 44' 30" West, passing over an iron pipe at 869.51 feet, a total distance of 899.51 feet to a point in the centerline of Twinsburg-Warren Road in Windham Township; thence North 50 deg. 15' 15" West, along said centerline 23.30 feet to the point of beginning and containing 7.917 acres of land as surveyed in April 1990 by Donald D. Harvey, Registered Surveyor No. 4112.

Said Premises Located at 8701 State Route 82, Garrettsville, Ohio 44231.

Said Premises Appraised at $105,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
