In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, April 18, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Brimfield to-wit:

Situated in the Township of Brimfield, County of Portage and State of Ohio and known as being part of Original Brimfield Township Lot No. 13 and is further described as follows:

Beginning at a bridge spike found in the centerline of Howe Road TH 83, 80' wide, at the Southwest corner of said Original Brimfield Township Lot No. 13; thence along the centerline of Howe Road and the Southerly line of said Lot 13 N. 89 deg. 50' 53" E., a distance of 1470.58 feet to a point and the true place of beginning for the parcel of land; thence N. 00 deg. 09' 07" W., a distance of 370.00 feet to an iron rod set and passing over an iron rod set at a distance of 30.00 feet; thence N. passing over an iron rod set at a distance of 44.39 feet from said centerline; thence along the centerline of Sherman Road S. 47 deg. 38' 17" E., a distance of 182.45 feet but to a point at the most Northerly corner of a 1.25 acre tract of land now or formerly owned by G. T. II or K. L. Strunk (1016/807), see also survey B-55); thence along the Westerly line of said 1.25 acre tract of land S. 41 deg. 51' 53" W., a distance of 332.06 feet but to a point in the centerline of Howe Road and Southerly line of said Lot 13 at Strunk's most Westerly corner and passing over iron pipes found, one at a distance of 30.24 feet and one at a distance of 40.38 feet from said centerline and lot line; thence along the centerline of Howe Road and Southerly line of said Lot 13 S. 89 deg. 50' 53" W., a distance of 167.35 feet but to the true place of beginning and containing a total of 2.4896 acres of land of which 0.1369 acres are currently occupied by the Sherman Road right-of-way and about 0.1245 acres and currently occupied by the Howe Road right-of-way, be the same more or less as surveyed and described in November 1998 by Don Trocchio, Registered Surveyor No. 6445.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
