In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, April 11, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Freedom to-wit:

Situated in the State of Ohio, County of Portage and Township of Freedom, and known as being part of Lot 3, in said township, also known as being all of that parcel conveyed to M. F. O'Donnell and S. M. Komatz as recorded in O.R. 246, Page 428 and being more fully bounded and described as follows, to wit:

Beginning at a 1" iron bar found at the Southwest corner of Lot 3; thence South 86 deg. 00' 00" East, along the South line of Lot 3 and the centerline of Gotham Road (T.H. 232-A) 60' R.W. 502.70 feet to the Southeast corner of a parcel conveyed to K. or T. Copojohn (1144/133) and being the true place of beginning for the parcel hereinafter described; thence North 03 deg. 59' 04" East, along the East line of said Copojohn Parcel (passing over a 5/8" rebar w/cap set at 30.00 feet) 1126.40 feet to a point in the South line of a parcel conveyed to L. A. Bujalski (O.R. 369, Page 380) (witness a 3/4" pipe found 0.21 feet North); thence South 86 deg. 00' 00" East, 265.63 feet along the South line of said Bujalski Parcel to the Northwest corner of a parcel conveyed to K. H. or D. E. Reed (1027/254) (witness a 3/4" pipe found 0.33 feet North + 1.35 feet West); thence South 03 deg. 58' 11" West, 566.89 feet along the West line of said Reed Parcel of a 1/2" pipe found at an angle in said line; thence North 85 deg. 33' 35" West, 90.67 feet continuing along said Reed's line to a 1/2" pipe found; thence South 03 deg. 57' 02" West, 560.21 feet continuing along the West line of said Reed Parcel to a point in the centerline of said Gotham Road (passing over a 3/4" pipe found 30.09 feet from the centerline); thence North 86 deg. 00' 00" West, 175.44 feet along the centerline of Gotham Road to the true place of beginning and containing 5.708 acres of land, more or less, as determined from a survey by Stephen P. Campbell, P.L.S. No. 7330 of Campbell and Associates, Inc., in March 2001 (C & A Project 20011065). The bearings used for this description are based on the bearing of Gotham Road as shown in O.R. 426, Page 458, be the same more or less, but subject to all legal highways.

Said Premises Located at 7923 Gotham Road, Garrettsville, OH 44231.

Said Premises Appraised at $150,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.

THE OWNER IS ALSO RESPONSIBLE FOR KNOWING EXACTLY WHAT HE IS PURCHASING.
