In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, March 28, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Nelson to-wit:

Situated in the Township of Nelson, County of Portage and State of Ohio:

Known as being part of Lot 39, township, county and state aforesaid and more particularly described as follows:

Beginning at an iron pipe found at the Southeast corner of said Lot No. 39 this iron pin is found at the centerline intersection of Highway No. 297 (Newell Ledge Road) and Highway No. 292 (Pierce Road); thence North 89 deg. 30' West, along the South line of said Lot 39 for a distance of 163.00 feet to an iron pipe which marks the true place of beginning of the following described parcel of land; this iron pipe is situated a distance of 712.71 feet South 89 deg. 30' East, from an iron pipe at the Southwest corner of a 36.50 acre parcel of land now owned by Eugene Jones and Betty Jones; thence North 00 deg. 02' West along the West side of a 0.632 acre parcel of land for a distance of 175.00 feet to an iron pipe; thence North 72 deg. 26' West along the Southerly side of Lot No. 1 of Colvin Estates as recored in Volume 11 at Page 26 of Portage County Records of Plats for a distance of 104.89 feet to an iron pipe; thence South 00 deg. 02' East for a distance of 205.79 feet to an iron pipe in the South line of said Lot No. 39; thence South 89 deg. 30' East along the South line of said Lot No. 39 for a distance of 100.00 feet to the true place of begininng and found to contain 0.437 acre of land as surveyed by Lucius F. Converse, Serial No. 1199 in October, 1956, be the same more or less, but subject to all legal highways.

Said Premises Located at 10151 Silica Sand Road, Garrettsville, OH 44231.

Said Premises Appraised at $80,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
