In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, February 14, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Charlestown to-wit:

All that certain parcel of land situated in the Township of Charlestown, County of Portage, State of Ohio, being known and designated as a part of Lot 34 in said township and bounded and described as follows:

Beginning at an iron rod at the Northwesterly corner of said Lot 34 at the intersection of the centerline of T.H. 189, Knapp Road and C.H. 177, Newton Falls Road; thence East along the Northerly line of Lot 34 and centerline of C.H. 177, a distance of 1885.95 feet to a point at the Northeasterly corner of land now or formerly owned by Barbara McConnell which marks the true place of beginning for the following described parcel of land; thence continuing East along the Northerly line of Lot 34 and centerline of C.H. 177, a distance of 106.20 feet to a point at the Northwesterly corner of land now or formerly owned by J. Willis Baldwin; thence South 00 deg. 02' 37" West along the Westerly line of said Baldwin (passing over an iron pipe at 29.34 feet) a distance of 2964.99 feet to an iron pipe in the Southerly line of Lot 34; thence South 88 deg. 46' 34" West, along the Southerly line of Lot 34, a distance of 396.09 feet to an iron pipe at the Southeasterly corner of land now or formerly owned by Thomas E. Griffith; thence North 00 deg. 00' 25" East along the Easterly line of said Griffith, a distance of 2340.19 feet to an iron pipe at the Southwesterly corner of land now or formerly owned by Ralph & Barbara Jarvis; thence East a distance of 289.00 feet to an iron pipe at the Southeasterly corner of said Jarvis; thence North 00 deg. 15' 00" East, along the Easterly line of said Jarvis and the Easterly line of the aforementioned Barbara McConnell, a distance of 633.26 feet to the true place of beginning, containing 22.836 acres of land, more or less, as surveyed October 4, 1976, by Albert Szuch, Registered Surveyor No. 5398.

Beginning at an iron rod at the Northwesterly corner of said Lot 34 at the intersection of the centerline of T.H. 169, Knapp Road and C.H. 177, Newton Falls Road; thence East along the Northerly line of Lot 34 and centerline of C.H. 177, a distance of 1885.95 feet to a point at the Northeasterly corner of land now or formerly owned by Barbara McConnell, which marks the true place of beginning for the following described parcel of land; thence continuing East along the Northerly line of Lot 34 and centerline of C.H 177, a distance of 50.00 feet to a point; thence South 00 deg. 15' 00" West, a distance of 683.25 feet to a point; thence West a distance of 238.79 feet to a point; thence South 00 deg. 00' 25" West, a distance of 300.00 feet to a point; thence West a distance of 100.00 feet to a point in the Easterly line of land now or formerly owned by Thomas E. Griffith; thence North 00 deg. 00' 25" East, along the Easterly line of said Griffith, a distance of 350.00 feet to an iron pipe at the Southwesterly corner of land now or formerly owned by R. K. and Barbara Jarvis; thence East, a distance of 289.00 feet to an iron pipe at the Southeasterly corner of said Jarvis; thence North 00 deg. 15' 00" East, along the Easterly line of said Jarvis and Easterly line of the aforementioned Barbara McConnell, a distance of 633.26 feet to the true place of beginning, containing 1.8045 acres of land, more or less, as surveyed May 11, 1977 by Albert Szuch, Registered Surveyor No. 5398.

Said Premises Located at 6464 Newton Falls Road, Ravenna, OH 44266.

Said Premises Appraised at $170,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
