In pursuance of an Order of Sale in the above entitled action, I will offer for sale at public auction, "on the 1st Floor of the Courthouse, in the Magistrate John P. O'Neill's Courtroom, Courtroom C in Ravenna, in the above named County, on Monday, February 7, 2011, at 11:00 A.M., the following described real estate, situated in the County of Portage and the State of Ohio, and in the Township of Shalersville to-wit:

And known as being part of Original Shalersville Township Lot No. 106 and is further described as follows:

Beginning at a point in the centerline of Diagonal Road, CH 155, 66' wide, at its intersection with the original centerline of State Route 303, Hudson-Braceville Road, right-of-way varies; thence along the original centerline of State Route 303, Hudson-Braceville Road, W. 81 deg. 20' 38" W., a distance of 15.41 feet to an angle point; thence continuing along the original centerline of State Route 303, Hudson-Braceville Road, S. 66 deg. 40' 22" W., a distance of 269.20 feet to a point; thence N. 00 deg. 30' 02" E., a distance of 474.46 feet to an iron rod set and passing over iron rods set, one at a distance of 36.11 feet and one at a distance of 237.23 feet; thence S. 88 deg. 49' 53" E., a distance of 257.91 feet to a point in the centerline of Diagonal Road and passing over an iron rod set at a distance of 33.00 feet from said point; thence along the centerline of Diagonal Road S. 00 deg. 06' 22" W., a distance of 364.89 feet to the beginning and containing a total of 2.4776 acres of land of which 0.2535 acres are currently occupied by the Diagonal Road right-of-way and about 0.2125 acres are currently occupied the State Route 303, Hudson-Braceville Road right-of-way, be the same more or less, as surveyed and described in May and June 1999 by Don Trocchio, Registered Surveyor No. 6445.

Said Premises Appraised at $80,000.00 and cannot be sold for less than two-thirds of that amount.

TERMS OF SALE: Cash.

A deposit of 10% of your bid is required from third party purchasers at the time of sale. Conveyance and Recording Fees are required from all bidders at the time of sale. The balance of the purchase price shall be paid within thirty (30) days after the date the confirmation is filed with the clerk.

The parcel described herein is subject to the Portage County Standards Governing the Conveyance of Real Property, effective July 1, 1998. If this parcel is required to be re-surveyed to meet these standards, such resurvey is the responsibility of the successful bidder at Sheriffs sale. Copies of the Conveyance Standards are available for inspection at the offices of the County Auditor and County Engineer.
